on the timetable for public rail and road passenger transport
The Ministry of Transport and Communications provides, pursuant to § 37 (7) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., (hereinafter referred to as the "Railway Act '), under § 18b (2) of Act No. 111 / 1994 Coll., on Road Transport, as amended by Act No. 304 / 1997 Coll., (hereinafter referred to as" Road Transport Act') and under § 7a (7) and § 36 (2) of Act No. 194 / 2010 Coll., on Public passenger transport services and amending other laws, as amended by Act No. 367 / 2019 Coll. (hereinafter referred to as "Public Services Act '):
INTRODUCTORY PROVISIONS
Subject matter
The decree lays down the conditions for the carriage of persons, baggage, goods and live animals in public rail passenger transport (15) and in public road passenger transport (16), including the conditions for the performance of one transport contract by several carriers (hereinafter referred to as the "timetable '). This decree applies to legal relations which are not covered by the directly applicable European Union rules on passenger rights in public rail and road passenger transport17).
Interpretation of certain terms
(1) Urban public transport is the activity of a carrier consisting of the regular carriage of passengers, hand luggage, luggage and live animals for the needs of the city and its peri-urban areas by special, tram, trolleybus and cableway vehicles, urban bus vehicles and vehicles within integrated public passenger services (18) on a different route, provided that the carrier does so under contractual conditions.
(2) The contractual terms of carriage are the carrier of the declared transport conditions pursuant to § 18b (2) of the Road Transport Act and § 36 (1) (a) and § 37 of the Railway Act.
(3) Luggage is an easily portable item which, due to its size and mass, can be easily placed in the vehicle or easily loaded into the vehicle, and a item which, by its nature, cannot damage or pollute passengers or vehicles.
(4) The delivery time is the time of transport of the luggage from the station or stop (hereinafter referred to as "the station ') of the submission to the station of destination by an agreed link, including the time needed for its preparation to be delivered.
TRANSPORT OF PERSONS IN PUBLIC SPECIES AND STRENGTH TRANSPORT
TRANSPORT CONTRACTS, RIDING DOCUMENTS AND RESERVE SERVICES
Creation and completion of the passenger transport contract
(1) The conclusion of a transport contract for passenger transport (hereinafter referred to as the "transport contract") establishes a binding legal relationship between the carrier and the passenger on the basis of the timetable, tariff (1) and contractual conditions, in particular the undertaking of the carrier to transport passengers from the boarding station to the destination station mentioned in the timetable in due time and the undertaking of the passenger to comply with the transport rules and contractual conditions and to pay the transport price (hereinafter referred to as "fare") by tariff.
(2) The contract of carriage shall be concluded at the latest by the passenger entering the vehicle or entering a marked space accessible only with a valid travel document (hereafter referred to as "vehicle embarkation ').
(3) The transport contract is satisfied by the proper execution of the transport in the agreed extent according to the contract.
(4) The performance of a transport contract shall also be deemed to have been carried out in a manner other than that agreed, where the passenger has been legally excluded from the carriage by the carrier authorised by the person.
Travel document and related travel documents
(1) For the purposes of checking the conclusion of a transport contract at the time of its completion, passengers are shown by a valid ticket.
(2) The travel document may take the form of:
(a) a travel document for a single journey authorising a passenger to conclude one or more transport contracts within the framework of the space and temporal validity of the document;
(b) a time-travel document authorising a passenger to enter into transport contracts repeatedly within the space and time validity of the document; or
(c) another document the holder of which has a right to transport under another legislation (2), (3), a tariff or contractual conditions within the framework of the spatial and temporal validity of the document.
(3) The travel documents shall be issued as transferable or non-transferable. A non-transferable travel document may be made out on the passenger or identified with the passenger at first use; the means of identification must in such a case be indicated in the contractual transport conditions.
(4) In cases specified by the carrier in the contractual terms and conditions, the passenger shall, in addition to the travel document referred to in paragraph 2, be shown by a related travel document which may be:
(a) the reservation document and the reservation document on the bed or couchette enabling the passenger to use the reserved space in the extent and under the conditions laid down in the contractual terms and conditions;
(b) a supplementary document authorising a passenger to change the route or transport conditions of the travel document to the extent and under the conditions laid down by the contractual transport conditions;
(c) proof of a supplement using a higher-quality connection enabling the passenger to use the higher-quality transport services provided for in the timetable.
Types of travel document
(1) The individual travel document contains:
(a) information on carriers with which a transport contract may be concluded shall also be considered to be the information referred to in this point to a remotely accessible list of carriers;
(b) entry and destination stations or tariff zones or tariff zones;
(c) the amount of the fare, the type of fare and, where applicable, the amount of the discount;
(d) indication of validity;
(e) particulars enabling the validity and accuracy of its use to be checked, provided that they have been laid down in the contractual transport conditions.
(2) The travel document shall contain the particulars referred to in paragraph 1 and shall include details of the type of time travel document and, where appropriate, particulars indicating the passenger authorised to use the travel document.
(3) The travel document referred to in Article 4 (2) (c) contains information provided for by other legislation (m2), (3), a tariff or contractual transport conditions.
(4) The single travel document shall contain the particulars provided for in paragraphs 1 to 3, depending on its form, in accordance with Paragraph 4 (2).
Assessment of the validity of travel documents
(1) The document shall not be considered valid if:
(a) the passenger has not complied with the conditions for its use laid down in the timetable, tariff or contractual conditions;
(b) the prescribed particulars are not completed,
(c) is used without the required photograph;
(d) is damaged in such a way that there is no indication of the data needed to check the accuracy of its use;
(e) the particulars do not correspond to the facts or have been tampered with;
(f) is used by an unauthorised person;
(g) the period of validity has not expired or expired;
(h) it is not the original.
(2) A travel document for a single journey or a time travel document which, according to the tariff, can only be used in conjunction with the document on the basis of which it was issued, shall not be considered valid if the passenger does not prove at the same time by that document.
(3) An invalid travel document for a single journey or an invalid journey document shall be authorised by the authorised person in the cases referred to in paragraph 1 (c) to (f) and (h); the removal of the travel document shall be confirmed in writing by the passenger.
Payment of fares and prices for related travel documents
(1) Passengers shall pay the fare according to the fare agreed in accordance with the price regulation.3) In addition to the fare, the price of the surcharge or reservation document [§ 4 (4) (a)] applies to the use of connections marked in the passenger timetable.
(2) The carrier ensures the sale of travel documents before entering the vehicle. If the carrier has not secured the sale of travel documents before boarding the vehicle, it must enable the passenger to purchase the travel document after boarding the vehicle for a free-of-charge fare. 4) The carrier shall indicate in the contractual transport conditions of the station or, where applicable, the lines or connections on which passengers are allowed to enter the vehicle without a travel document and the purchase of a travel document without a surcharge (4) after boarding the vehicle.
(3) The passenger pays the fare before boarding the vehicle and the carrier issues the ticket for the fare paid. If passengers pay the fare after boarding the vehicle, the carrier shall issue the ticket in the vehicle or ensure that the fare thus paid is registered by the check-in system.
(4) On receipt of the travel document, passengers shall satisfy themselves that they have been issued to them in accordance with their requirements. If the information given on the travel document does not agree with the information requested, the passenger may refuse the travel document.
(5) If a passenger has not purchased a travel document before boarding the vehicle, even if the carrier has allowed it to do so, he may board the vehicle without a travel document if the carrier provides for the sale of travel documents in the vehicle and the passenger buys the journey document after boarding the vehicle without delay. (4) The amount of this premium shall be determined by the carrier in the contractual terms and conditions and indicated in the tariff. The carrier shall indicate in the contractual terms and conditions the lines or connections for which it is possible to purchase a travel document with a mark-up.4)
(6) If a passenger does not purchase a travel document in accordance with paragraph 3 or paragraph 5 and is transported without a valid travel document, he shall be considered as a passenger who, for reasons relating to his or her part, has not been proved by a valid travel document. 5)
(7) The details concerning the sale of travel documents and related travel documents, the conditions for their return, the type, form and, where applicable, models of travel documents and related travel documents and the means of identifying travel documents for a single journey in the self-service mode of passenger handling shall be laid down by the carrier in the contractual conditions of carriage.
(8) The sale of uniform travel documents shall be ensured at the commercial locations of the carriers, on public rail passenger trains on the national and regional track allowing the use of transport services on the basis of a single travel document and in a manner that allows remote access with access to, and for, persons with reduced mobility.
Right of occupancy of seating positions in the vehicle
(1) A passenger may occupy only one seating position on the vehicle, unless the contractual conditions of carriage provide otherwise.
(2) Passengers with reduced mobility and orientation (6) shall have priority when occupying seating positions reserved in the vehicle and marked for the carriage of such persons.
(3) The place on which a reservation document has been purchased may be filled by a passenger without a reservation document only if this place is not claimed by a passenger with a valid reservation document and is not a connection to which a passenger must purchase a reservation document.
Provision of reservation services for carriage in vehicles
(1) The timetable carrier shall ensure that public rail passenger transport connections on the national and regional rail and public road passenger transport routes other than urban public transport in which passengers may or must purchase a reservation document in advance and at the same time publish the terms of its sale.
(2) The reservation document shall include the amount of the price paid for the reservation document, the identification of the connection and the reserved place in the vehicle and the information enabling the check of the validity and accuracy of its use. The carrier shall ensure that the places which he has reserved for the sale of reservation documents are marked on the vehicle.
(3) In order to ensure the right to a seating position reserved for a passenger on a wheelchair for disabled persons or for a passenger with reduced mobility, such facts must be reported when buying a reservation document; when buying a reservation document for a public road passenger transport connection, it is necessary to further state whether it is a place for a passenger under 12 years of age, a passenger with a child carriage or a passenger with a dog.
(4) For carriage in sleeper or couchette carriages, the passenger must also have a reservation document for the berth or couchette of the carriage class and category used. The carriage of passengers in sleeper or couchette carriages is permitted only if the passengers are shown by a reservation document on the bed or couchette.
(5) Further details on the conditions for occupying the seats reserved by the booking documents and the conditions for carriage in sleeper and couchette carriages shall be provided by the carrier under the contractual conditions of transport.
CONDITIONS OF TRANSPORT OF CERTAIN PERSONS AND MATTERS
Child transport
(1) Children under the age of six can only be transported with a person older than 10.
(2) In places in vehicles reserved and designated by the carrier for the carriage of passengers with children under 10 years of age, these passengers shall preferably be carried. Any other passenger who has occupied such a place shall, upon request, release the place to the traveller with the children, even if he has purchased a reservation document for that place without having been able to prove his entitlement to it. Before buying a reservation, the carrier will alert the passenger to the reservation of this place for passengers with children under 10 years of age.
(3) Additional conditions for the transport of children shall be laid down in the tariff and contractual conditions.
Transport of baby carriages and bicycles
(1) A passenger may take a child carriage with a child into the vehicle if the technical design of the vehicle and its occupancy so permit, either as hand luggage or as oversized luggage under the carrier's contractual conditions of carriage.
(2) The carrier on the connections of the transport service (7) ensures the use of vehicles which allow the transport of at least one child carriage with the child.
(3) The conditions for the boarding and exit of a passenger with a child carriage, the location of a pram with a child in the vehicle and the details of the conditions of carriage shall be laid down by the carrier under the contractual conditions of carriage.
(4) A child carriage without a child and a bicycle can be carried as oversized luggage if the carrier allows it in the contractual conditions of carriage; otherwise the provisions on the carriage of luggage shall apply. A bicycle means a similar means of transport from the point of view of transport, provided that the contractual transport conditions so provide.
Transport of persons with reduced mobility
(1) Passengers with reduced mobility are entitled to a seating position on seats reserved for them and marked on the vehicle. If their right to a seating position is not clearly evident for these persons, they shall show their claim by means of the appropriate pass. Any other passenger who has occupied such a place shall release that seat to a passenger with reduced mobility at his request, even if he has purchased a reservation document for that place without being able to prove his entitlement to it. Before buying a reservation, the carrier shall alert the passenger to the reservation of a reserved place for passengers with reduced mobility.
(2) At least two seats for passengers with reduced mobility shall be reserved and marked by the carrier in each individual vehicle. In urban public transport, the carrier shall reserve and designate at least six seating positions in each individual vehicle for this purpose. On a cableway with closed vehicles, a seating position for passengers with reduced mobility shall be reserved and marked in at least one vehicle.
(3) Passengers with reduced mobility must be allowed to enter and exit from the vehicle in urban public transport through all doors marked for entry or exit of passengers.
(4) The details of the conditions of boarding and leaving of passengers with reduced mobility are laid down by the carrier in the contractual conditions of carriage.
Transport of disabled persons
(1) The carrier shall carry a passenger on a wheelchair in a wheelchair, or if the technical design of the vehicle and its occupancy so permit, and at the same time assistance shall be provided for the boarding and disembarking of a passenger on a wheelchair to and from the vehicle, whether or not in another vehicle.
(2) The carrier shall arrange the carriage referred to in paragraph 1 on connections which are also marked in the timetable for the carriage of passengers on a wheelchair for disabled persons.
(3) Where a carrier in public rail passenger transport on a national and regional rail is requested in advance to ensure the carriage of a passenger on a wheelchair for disabled persons within the time limit laid down in the contractual conditions of carriage, the passenger shall be carried in accordance with the agreed conditions.
(4) The details of the conditions for the carriage of a person in a wheelchair and the location of a wheelchair in a vehicle are laid down by the carrier under the contractual conditions of carriage.
RELATIONS BETWEEN TRANSPORT AND TRAVEL
The carrier is obliged to ensure, in the interest of proper care of passengers when providing transport services,
(a) the provision of information on timetables, tariffs and contractual transport conditions, at places intended to contact passengers and in a way that allows remote access;
(b) the sale of travel documents at a station or at selected places accessible to the public during the period of the provision of transport services to passengers in public passenger transport by timetable, provided that, under the contractual conditions of carriage, the passenger must have a travel document before entering the vehicle;
(c) notification of the delay of the connection, in the vehicle and in the station, if they are equipped with a passenger information device if the delay is 10 minutes or more compared to the timetable; This does not apply to public transport,
(d) the issue of a written confirmation of the restriction or the cessation of transport, the omission of the connection or the delay of the connection, if the delay is 10 minutes or more compared to the timetable, if the passenger so requests, except for urban public transport; the places of certification shall be determined by the carrier under the contractual conditions of transport;
(e) order, purity and rest in the vehicle;
(f) the use of audiovisual equipment by passengers in a vehicle which would not be difficult for other passengers;
(g) notification of the name of the station at the latest at the stop of the vehicle at the station and in public transport of the next station at the latest at the time of departure of the vehicle from the station; where the vehicles are equipped with a technical device enabling the station name to be notified; the station names shall not be notified on the cable track,
(h) in public road passenger transport and in urban public transport, the re-stop of each third vehicle at the level of station designation, if there are at the same time more vehicles at the station; the re-stop of each vehicle at the level of the station designation in the case of a person in a wheelchair or disabled person with a white or red and white cane.
(1) A breach of the conditions of carriage in terms of passenger safety, safety of other persons and protection of the health, safety and continuity of public passenger transport and in terms of ensuring proper, peaceful and convenient transport is
(a) it does not have a travel document purchased at the time of embarkation of the vehicle, even if the carrier has enabled it to purchase it before embarkation of the vehicle, or does not purchase it without delay after embarking on the vehicle when such a procedure is permitted under the contractual conditions of carriage;
(b) it cannot be demonstrated by a valid travel document, refuses to pay the fare and the on-the-spot premium;
(c) refuse to release a seat for a passenger with a valid reservation document to that place or refuse to release a seat reserved for persons with reduced mobility to such persons or refuse to release a seat reserved for a passenger with a child under 10 years of age;
(d) speak to the person driving the vehicle while driving;
(e) opening the door of the vehicle or the barrier against falling off while driving;
(f) discards or makes objects protruding from the vehicle;
(g) disembarking or embarking on or leaving the vehicle while driving;
(h) enter a vehicle declared occupied by the authorised person;
(i) unreasonably activates signalling equipment in the vehicle;
(j) it is unreasonably present in the area reserved for persons driving or accompanying the vehicle or in the area which makes it impossible for the person driving the vehicle to view safely from the vehicle;
(k) prevent the use of operating equipment, output, passage or entry into the vehicle;
(l) smoke in a vehicle or passenger compartment where smoking is not permitted;
m) acts loudly, reproduces loud music or singing or uses loud audiovisual technology or harasses other passengers by other inappropriate behaviour or odour;
(n) polluting other passengers or vehicles, as well as spaces and equipment for passengers by their clothing or by their action;
(o) damages the vehicle as well as passenger spaces and equipment;
(p) unlocks or locks a key or other object which is not part of a vehicle, a car door or a compartment on public rail passenger trains on a national, regional and metro track and a door in a tram, trolleybus, bus and cableway vehicles;
(r) has taken with him to the vehicle or has submitted, for carriage as a luggage, a item which must not be the contents of the luggage; or
(s) national or regional runway
1. the delay of the train is due;
2. travels on a train of higher quality and is not shown by proof of payment of the premium price using a train of higher quality;
3. travels in the upper carriage class for which he does not have the corresponding travel document;
4. travels without a reservation document on a train in which each passenger must have a reservation document.
(2) In view of the nature of the transport, the carrier may, under the contractual conditions of transport, adjust the additional obligations of passengers to protect the health, safety or continuity of transport. The conduct of a passenger contrary to these obligations shall be regarded as a violation of the conditions of carriage.
(1) A passenger standing in a vehicle shall be restrained when the vehicle equipment intended for that purpose is in motion.
(2) Passengers may enter or leave the vehicle only at the station and if the vehicle is not in motion. Priority is given to performing passengers before boarding. If the vehicle door is marked for entry and exit, the passenger shall use the door as indicated for entry or exit.
(3) The passenger is obliged to stop entering and entering the vehicle if there is a sound call to stop boarding and exit.
(4) If the vehicle is stopped for operational reasons outside the station or in a station where it does not stop according to the timetable, the passenger may leave or, if necessary, board only with the consent of the driver or other authorised person of the carrier.
(5) Only such travel documents may be entered in the premises designated as being accessible only on the basis of a valid travel document; on a national and regional track, with or without any other document authorising entry into those premises. Any person present in these premises shall, upon request of the authorised person, be provided with the appropriate document in force.
(1) A passenger wishing to board the station on a sign must take the place from which the person driving the vehicle will be seen, and this must stop if a person is present in the station space.
(2) Passengers wishing to perform as a signal at the station must use the relevant signalling equipment or inform the person driving the vehicle or the train crew in due time of their intention.
(3) The carrier may, under contractual conditions of carriage, adjust the additional obligations of passengers to enter and exit the vehicle at the station by means of a sign, such obligations shall be understandable, safe and applicable to persons with reduced mobility.
(1) Sound and visual information equipment used in public passenger transport serves as a priority for the provision of safety and passenger information.
(2) Passengers may use communication, security and information devices located in spaces intended for passengers and in vehicles only according to the instructions of their operator and in accordance with the purpose of using such devices.
TRANSPORT OF BUSINESS AND TRANSPORT IN THE PUBLIC AND ROAD PERSONAL TRANSPORT
GENERAL PROVISIONS
Means of transport of luggage
Luggage shall be transported with and under the supervision of a passenger in a vehicle as hand luggage or as oversized luggage, or transported separately from the passenger as a luggage.
Luggage and its contents
(1) The luggage or contents of the luggage must not be goods which, by their characteristics, may cause damage to the vehicle, as well as to the life and health of persons or their property, and goods which are not in stock, unless otherwise specified.
(2) A thing which may not be a baggage or a contents of baggage is in particular a loaded weapon, an explosive, toxic, radioactive, volatile and corrosive item or a thing which may cause a disease, or a thing which cannot be placed in a vehicle in a place intended to accommodate baggage, or a thing weighing more than 50 kg, unless otherwise specified.
(3) Flammable and dangerous goods may be transported when provided for by the carrier in the contractual conditions of transport.
CONDITIONS OF TRANSPORT OF BUSINESS
Hand luggage
(1) As hand luggage, a passenger shall have the right to bring to the vehicle, free of charge, easily portable items carried by the passenger and, where appropriate, placed in the vehicle under the seat or above the passenger's seat. The passenger is responsible for ensuring the safe handling and supervision of such luggage.
(2) The details of the transport of hand luggage, in particular the dimensions, weight and, where appropriate, the types of goods carried and their location in the vehicle, may provide for contractual conditions of carriage.
Oversized luggage
(1) Goods may be transported as oversized luggage which exceed the dimensions of hand luggage and require placing on a specially designated location by the carrier in the vehicle in the passenger compartment. The passenger is responsible for ensuring the safe handling and supervision of such luggage.
(2) No transport contract shall be concluded for the carriage of luggage, but passengers shall pay the price according to the carrier's fare.
(3) The details of the carriage of oversized luggage, in particular the dimensions, weight and types of goods carried, are laid down in the contractual transport conditions.
Travel baggage
(1) Travel baggage is a passenger's luggage which is accepted for carriage under a separate transport contract, upon presentation of a passenger's travel document valid at least to the station to which the passenger requests to transport the luggage.
(2) As a luggage, a passenger may lodge a baggage weighing not more than 15 kg without special precautions. Special measures allowing the carriage of luggage of more than or equal to a number of pieces may provide for contractual transport conditions.
(3) A national and regional railway carrier may, under contractual conditions, provide that it also accepts live animals or a passenger car for carriage as a luggage. 8)
(4) The carrier shall ensure the publication in the timetable of the specified extent of carriage of luggage. If the carrier does not carry out the carriage of luggage by all the connections operating on the timetable, it shall indicate in the timetable the connections by which the luggage is carried.
Live animals
(1) Live animals may be transported under the conditions laid down for baggage, unless special legislation9) and unless otherwise provided for in these Regulations. Live animals such as hand luggage or oversized luggage may be transported only under the supervision of a passenger, and if conditions are met to ensure that live animals do not damage or pollute a passenger or a vehicle, do not endanger the safety and health of persons and are not a nuisance to other passengers during transport. Of live animals, only small domestic and other small animals may be taken into the vehicle by passengers, provided that they are completely sealed in easily portable cages, baskets or other suitable containers with an impermeable day, unless otherwise provided by this decree or by the carrier in the contractual transport conditions.
(2) For the transport of containers with animals in the vehicle, if the storage does not satisfy the conditions for the carriage of hand luggage, the provisions on the transport of oversized luggage shall apply.
(3) Without storage, passengers may take a dog with them to the vehicle which has a safe muzzle throughout the journey, is kept on a short leash and must not be carried on the seat. The transport fee for the dog transported in this way is based on the fare.
(4) The carrier may, under contractual conditions of carriage, restrict or exclude the number of dogs on certain connections on a guide at the same time carried in the vehicle and the authorised person may refuse the transport of the dog without storage because of the occupancy of the vehicle and the safety of passengers.
(5) A guide dog accompanying a blind person, an assistance dog accompanying a disabled person, as well as a service dog (10) cannot be excluded from transport or transport.
