laying down further cases where an apartment may be allocated in the public interest
The Government of the Czech Republic orders pursuant to § 20 paragraph 2 of Act No. 41 / 1964 Coll., on the Management of Houses ("the Act"):
(1) In view of the State interest, except in the cases referred to in Section 20 (1) of the Act, an apartment may be allocated outside the waiting list:
(a) citizens who have been evicted from the flat on the basis of an unlawful decision taken by the State authority or by its maladministration; 1)
(b) members of the Bureau of the Czech National Council;
(c) personnel of the central public authorities who are in direct management of the head of that body or who are in the capacity of the head of the department or of the organisational unit established by it, on the sole proposal of the head of that central public authority;
(d) to professional judges on a proposal from the Minister of Justice;
(e) prosecutors and investigators of the Prosecutor General's Office on a proposal;
(f) citizens who care for at least three children born at the same time.
(2) The flat outside the waiting list may exceptionally also be allocated to citizens who have been asked by the government to return from abroad permanently.
(3) The persons referred to in paragraphs 1 and 2 may be allocated an apartment in the public interest only if they fulfil the conditions laid down in the law.2)
The Government Order of the Czech Socialist Republic No. 36 / 1969 Coll., setting out other cases where an apartment can be allocated in the state interest, as amended by the Government of the Czech Socialist Republic Decree No. 88 / 1970 Coll., No. 1 / 1985 Coll. and No. 85 / 1986 Coll.
This Regulation shall enter into force on the day of its publication.
