on details of the method of re-collection of certain products
According to § 38 (10) of Act No. 185 / 2001 Coll., on waste and on the amendment of certain other laws, hereinafter referred to as "the Act", the Ministry of the Environment provides:
(1) This Decree applies to all the products referred to in § 38 (1) (a) to (e) of the Act. Electrical equipment originating in households [Paragraph 38 (1) (f) of the Act] is subject only to the provisions of paragraphs 3 and 3.
(2) Withdrawal means the removal of used products by obliged persons from consumers (1) without payment for use or disposal.
(3) Recovery shall not apply to products which have been treated as waste m2) before they have been handed over to the obliged person.
(4) The management of waste which has been recovered from the products referred to in paragraph 1 as a transfer to the operator of the recovery or disposal facility shall be subject to the obligations laid down in the law and implementing legislation on it.
(5) Where a product is part of a functional unit, it shall be considered as a mandatory person to withdraw it from the manufacturer of the product or importer of the functional unit.
Providing information to the seller and consumer
(1) The mandatory person normally (e.g. in the accompanying documentation, on the delivery note, flyer or electronically - internet) will provide information on the possibility of repurchasing his product to a legal person or to a natural person authorised to do business who sells the products referred to in Paragraph 38 (1) of the Act to the consumer (hereinafter referred to as the "last seller").
(2) The information on the method of ensuring the recovery which the last seller has to provide to the consumer pursuant to Article 38 (5) of the Act must at least include:
(a) the name, address and telephone connection of the point of return;
(b) the types of products withdrawn;
(c) the operating time of the readmission;
(d) a notice on the non-refundable withdrawal.
(3) In the case of re-collection directly at the premises of the last seller, the place of re-collection of the products used shall be clearly marked "Place of re-collection of the products used ', the words" used products' being replaced by the name of the product to be taken at that place. This marking must be legible from places accessible to consumers.
(4) The points of re-procurement shall be considered as being as available as the points of sale, provided that at least one re-procurement point is provided for in each municipality or in each district or part of the city (if established) where the shops of such products are located.
Efficacy
This decree shall take effect on the day of its publication.
