GOVERNMENT REGULATION
of 9 July 2001
laying down a safeguard measure for imports into the Czech Republic of certain products
The Government mandates pursuant to Sections 19 and 21 of Act No. 62 / 2000 Coll., on certain measures for the export or import of products and on licensing and amending certain laws:
(1) For goods covered by the Customs Tariff (1) under subheadings 1702 30 10 - Isoglucose, 1702 40 10 - Isoglucose, 1702 60 10 - Isoglucose, 1702 90 30 - Isoglucose, 1702 90 99 - Other, 2106 90 30 - From isoglucose and 2106 90 59 - Other, provisional safeguard measures are hereby terminated (2) and the rate of import duty fixed by the Customs Tariff (1) or international contract (3) for the tariff quotas fixed for the relevant periods set out in the Annex hereto applies.
(2) The tariff quota is opened at 8.00 on the first day of the period for which that quota is opened. If this day falls on a Saturday, Sunday or a public holiday, the quota shall be opened on the next working day.
(1) Before and after the tariff quota has been opened in accordance with Article 1, the rate of the import duty fixed by the Customs Tariff (1) or the international contract (3), plus 95, shall apply to goods under subheadings 1702 30 10, 1702 60 10 and 1702 90 30.
(2) If the duty calculated in accordance with paragraph 1 is less than 8 CZK / kg, the duty rate shall be 8 CZK / kg.
(1) Before and after the tariff quota has been opened in accordance with Article 1, the rate of import duty fixed by the customs tariff (1) or the international contract (3) shall be applied to goods under subheading 1702 90 99 plus 163.
(2) If the duty calculated in accordance with paragraph 1 is less than CZK 13.6 / kg, the duty rate shall be CZK 13.6 / kg.
(1) Before and after the tariff quota has been opened in accordance with Article 1, the rate of the import duty fixed by the customs tariff (1) or the international contract (3) shall be applied to goods under subheadings 2106 90 30 and 2106 90 59.
(2) If the duty calculated in accordance with paragraph 1 is less than CZK 7 / kg, the duty rate shall be CZK 7 / kg.
(3) The provisions of paragraphs 1 and 2 shall not apply to goods in glass bottles of a capacity not exceeding 0,7 l.
(1) The provisions of Sections 1, 2, 3 and 4 shall not apply to goods originating in a developing country (1) or least developed country (1) which is a member of the World Trade Organisation (4), provided that its share of imports of the goods defined in Section 1 does not exceed 3% of the total imports of those goods and that imports from those countries with a share of less than 3% do not represent more than 9% of the total volume of the imported goods.
(2) Religious goods originating in a developing country or least developed country are goods which meet the conditions laid down in specific legislation. 5)
Decree No 19 / 2001 Coll., laying down provisional safeguard measures on imports of certain products into the Czech Republic, is hereby repealed.
(1) This Regulation shall enter into force on the day of its publication.
(2) This Regulation shall expire on 31 December 2004.
