of 3 July 2000
amending Government Regulation No 182 / 1999 Coll., laying down technical requirements for pressure equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll., ("the Act ') to implement Sections 11, 12 and 13 of the Act:
Čl. I
Government Regulation No 182 / 1999 Coll., laying down technical requirements for pressure equipment, is amended as follows:
1. in Article 1, the following paragraph 1 is inserted:
"(1) This Regulation lays down technical requirements for pressure equipment in accordance with the law of the European Communities (1) and the international contract (1a).
1) Directive 97 / 23 / EC of the European Parliament and of the Council of 29 May 1997 on the approximation of the laws of the Member States relating to pressure equipment.
(1a) Protocol to the Europe Agreement on conformity assessment and acceptance of industrial products. "
Footnote 1) shall be renumbered footnote 1 (b), including the footnote reference.
Paragraphs 1 and 2 shall become paragraphs 2 and 3.
2. in Article 1 (3), the following point (i) is added:
"(i) European approval for materials is a technical document defining the characteristics of materials intended for reuse in the manufacture of pressure equipment not covered by any harmonised Czech technical standard (§ 4a (1) of the Act) or by a foreign technical standard transposing a harmonised European standard in the countries of the European Union."
3. in Article 1 (3) (e), "intended for motor vehicles" is replaced by "intended for the operation of motor vehicles."
4. In Paragraph 1 (3) (g), the word "designated 'is deleted.
5. In Paragraph 1 (3) (s), the symbol "l 'is replaced by the symbol" L'.
6. In Article 1, the following paragraph 4 is added:
"(4) The exhibition of pressure equipment or assemblies referred to in paragraph 2 at trade fairs and exhibitions shall not be considered as marketing if they are visibly marked with an indication that they do not meet the requirements laid down, that they are not intended for sale and that adequate measures are taken to guarantee the protection of persons. ';
8. In Article 2 (2), the words "standards (Section 4 (4) of the Act) 'are replaced by" Czech technical standards (Section 4a (1) of the Act) or by foreign technical standards transposing a harmonised European standard in the Member States of the European Community'.
9. In Article 2, the following paragraph 3 is added:
"(3) Pressure equipment or assemblies with values lower or equal to the limits laid down in § 3 (3) (a) to (e) shall be designed and constructed in such a way as to correspond to the state of scientific and technical knowledge known at the time of their placing on the market."
10. in Article 3 (3) (a), "l" is replaced by "L";
11. in Article 3 (3) (e), the symbol "l" is replaced by the symbol "L."
12. in Paragraph 4 (1):
"(1) Where pressure equipment of materials whose properties are subject to the essential requirements referred to in Annex 1 to this Regulation is placed on the market but are not subject to any technical standards referred to in Section 2 (2), the manufacturer of the materials or pressure equipment shall ensure that the material characteristics of the authorised person for which they are intended are assessed. On the basis of that assessment, an authorised person shall issue a material certificate or, in cases referred to in Section 7a, a European approval for materials [Paragraph 1 (2) (i)] certifying the suitability of the technical characteristics of materials intended for reuse in the manufacture of pressure equipment in relation to the essential requirements for pressure equipment. Materials used for the manufacture of pressure equipment which are in conformity with the material certificate or, in the cases referred to in Section 7a, with the European approval for materials shall be considered to comply with the essential requirements set out in Annex 1 to this Regulation. ';
13. in Article 4 (2), the words "or importer" shall be deleted;
14. in Paragraph 4 (3):
"(3) The Authorised Person shall establish and carry out, where appropriate, the necessary checks and tests on the types of materials in order to certify their conformity with the relevant requirements of this Regulation and, on the basis of their results, issue a material certificate or, in cases referred to in Section 7a, a European approval for materials.";
15. in Article 4, paragraphs 4 to 8 are added:
"(4) Before issuing a European approval for materials, the authorised person shall inform and send relevant information to the Technical Standardisation, Metrology and State Testing Office (hereinafter referred to as" the Office '). The authorised person shall issue a European approval for the materials, taking into account the comments submitted.
(6) An authorised person who has issued a European approval for materials for pressure equipment shall withdraw such approval if he finds that it should not have been issued, or if the technical standards referred to in Article 2 (2) apply to that type of material.
(7) The Authorised Person shall immediately inform the other Authorised Persons and the Authority of any withdrawal of approval.
16. in Article 5 (1), the words "or authorised representative, as the case may be," shall be inserted after the word "manufacturer," and the words "conformity assessment by choice by some," shall be replaced by "conformity assessment by one."
17. in Article 5 (1) (a), the words "conformity assessment by manufacturer or importer" are replaced by the words "internal control of production."
18. in Article 5 (1) (b) (1), the words "conformity assessment by a manufacturer or importer with a random check authorised by a person" shall be replaced by "internal control of production with the supervision of the final assessment."
19. in Article 5 (1) (b) (2), the words "system assessment" are replaced by the words "security."
20. in Article 5 (1) (b) (3), the words "assessment of the quality system of pressure equipment" shall be replaced by "product quality assurance."
21. In Article 5 (1) (c) (1), the words "conformity assessment of pressure equipment with essential requirements authorised by the person at the design stage and assessment of the production quality system after type examination" are replaced by the words "EC design examination and quality assurance."
22. in Article 5 (1) (c) (2), the words "conformity assessment of pressure equipment with essential requirements authorised by a person at the design stage and verification of conformity of pressure equipment authorised by a person" shall be replaced by "EC design examination and verification of products."
23. in Article 5 (1) (c) (3), the words "type examination and assessment of the quality system of pressure equipment after type examination" are replaced by the words "EC type examination and product quality assurance."
24. in Article 5 (1) (c) (4), the words "EC type-examination and verification of conformity of pressure equipment with a certified type by a manufacturer or importer with a random check by an authorized person" shall be replaced by "EC type-examination and conformity with the type."
25. in Article 5 (1) (d) (1), the words "type examination and assessment of the production quality system after type examination" shall be replaced by the words "EC type examination and quality assurance."
26. in Article 5 (1) (d) (2), the words "type-examination and verification of conformity of pressure equipment authorised by a person" shall be replaced by "EC type-examination and verification of products."
27. in Article 5 (1) (d) (3), the words "conformity of each pressure equipment authorised by a person" shall be replaced by "whole."
28. in Article 5 (1) (d) (4), the words "by verifying the conformity of pressure equipment with the essential requirements at the design stage with a random check by an authorized person" shall be replaced by "EC design examination and special supervision of the final assessment."
29. in Paragraph 5 (2), the words "manufacturer or importer" are replaced by the words "conformity assessment";
30. in Article 5 (3), the words "or 5.4, as the case may be," shall be inserted after the words "point 4.4."
31. in Article 5 (4), the words "with the verification of conformity of the product with the essential requirements at the design stage by an authorized person and with random checks by an authorized person" shall be deleted.
32. In Article 5 (6), the words "In cases of a procedure for attesting conformity of a pressure equipment authorised by a person in accordance with Annex 3 to this Regulation, point 10 (conformity assessment procedure F) and the procedure for attesting conformity of each pressure equipment authorised by a person in accordance with Annex 3 to this Regulation, point 11 (conformity assessment procedure G)" shall be replaced by the words "In cases of a conformity assessment procedure F according to point 10 of Annex 3 to this Regulation and the conformity assessment procedure G according to point 11 of Annex 3 to this Regulation."
33. In Article 5, paragraphs 7 to 9 are added:
"(7) By way of derogation from paragraphs 1 to 5, ministries and other administrative authorities may, where justified, permit the placing on the market and putting into service of individual pressure equipment and assemblies referred to in paragraph 1 for which the conformity of the procedures referred to in paragraphs 1 to 5 has not been assessed if their use serves experimental purposes.
(8) Documents and correspondence relating to conformity procedures shall be drawn up in the Czech language or language agreed upon by the authorised person.
(9) The information referred to in points 3.3 and 3.4 of Annex 1 to this Regulation shall be given in the Czech language or in the language of the end-user of the pressure equipment or assembly. "
34. In Article 6, the current text is renumbered as paragraph 1, the words "paragraph 4 'are replaced by the words" paragraph 8' and the words ", where appropriate by an authorised representative 'are inserted after the word" manufacturer'.
35. in Article 6, the following paragraph 2 is added:
"(2) In cases resulting from Paragraph 13 (8) of the Act, the importer shall submit to the supervisory authority documentation in the official language of the country in which the product originates or in a language agreed with the supervisory authority. '
36. The following Sections 6a to 6d are inserted after Section 6, including footnote 8:
„§ 6a
(1) The CE8 marking must be accompanied by the identification number of the authorised person who has been supervised at the production stage. The CE marking shall be affixed in a visible, easily legible and indelible manner.
(a) for each pressure equipment referred to in Article 3 (1) (a) to (d); or
(b) for each assembly referred to in Article 3 (1) (e),
which are complete or are in a stage which allows final assessment as set out in Annex 1, point 3.2.
(2) It is not necessary to place the CE marking on each individual pressure device forming the assembly. Individual pressure equipment already bearing the CE marking, if incorporated in the assembly, shall continue to bear that marking. Where other government regulations apply to pressure equipment or assemblies which include other aspects for the location of the CE marking, the CE marking shall indicate that the pressure equipment or assembly concerned is considered to comply with the provisions of those other government regulations. However, if one or more such government regulations would allow the manufacturer to choose which procedure to apply during the transitional period, the CE marking shall only indicate compliance with the government regulations used by the manufacturer. In this case, the information on the relevant government regulations shall be provided in the documents, notes or instructions for use required by those government regulations and attached to the pressure equipment or assembly.
(3) Any other marking may be affixed to the pressure equipment or assemblies provided that this does not impair the visibility and legibility of the CE marking.
§ 6b
The conditions (Section 11 (2) of the Act) set out in Annex 4 to this Regulation apply to the authorisation of legal persons. Authorised persons meeting the criteria laid down in the technical standards referred to in Article 2 (2) shall be deemed to comply with the conditions set out in Annex 4 to this Regulation.
§ 6c
In authorising organisations to perform the tasks referred to in points 3.1.2 and 3.1.3 of Annex 1 to this Regulation, the conditions (Paragraph 11 (2) of the Act) set out in Annex 4 to this Regulation shall apply. Organisations meeting the criteria set out in the relevant technical standards referred to in Article 2 (2) shall be considered as meeting the conditions set out in Annex 4 to this Regulation.
§ 6d
(1) Under the conditions laid down in this paragraph, conformity to the essential requirements may be assessed by the pressure equipment user's test rooms (hereinafter referred to as "the user ') authorised in accordance with paragraph 8.
(2) Under the conditions laid down in this paragraph, pressure equipment or assemblies may be placed on the market or put into service, the conformity of which has been assessed by a test user having its registered office in the Czech Republic or in the Member States of the European Community in accordance with the criteria set out in this paragraph.
(3) Pressure equipment and assemblies the conformity of which has been assessed by the user test shall not bear the CE marking.
(4) Such pressure equipment or assemblies may be used only in business premises controlled by a group of users of which the test room is part. This group shall apply a uniform safety concept as regards the technical requirements for design, production, control, maintenance and use of pressure equipment and assemblies.
(5) User testing only operates within the user group of which they are part.
(6) The conformity assessment procedures used by the user services correspond to those described in Annex 3 to this Regulation.
(7) User testing centres shall notify the Office of the list of users referred to in paragraph 5 meeting the provisions of paragraph 4.
(8) The conditions set out in Annex 5 to this Regulation and the conditions set out in the second sentence of paragraph 4 shall apply to the authorization of the test subjects of users.
8) Government Decree No 291 / 2000 Coll., laying down the graphic form of the CE marking. '
37. The following Section 7a is inserted after Section 7:
„§ 7a
In the case of pressure equipment and assemblies originating in the Czech Republic or in the Member States of the European Community which comply with the requirements of this Regulation, the manufacturer and, where applicable, the authorised representative shall place the CE marking on the product and draw up the EC declaration of conformity as set out in Annex 6 to this device, except in the cases referred to in Article 8. For these products, where specified in this Regulation, the European approval for materials, the EC certificate of conformity, the EC design examination certificate and the EC type-examination certificate shall be issued instead of the material certificate, the certificate of conformity and the EC type-examination certificate. ';
38. In Annex 1, point 2.2.2 (b), the symbol "l 'is replaced by the symbol" L'.
39. in Annex 1, point 2.5 (a), the words "u" shall be inserted after the words "testing," in particular.
40. In Annex 1, point 2.6, the words "force additions secured 'are replaced by the words" Thickness enhancements proposed'.
41. In Annex 1, point 2.11.2, the words "when the safety equipment is involved 'shall be inserted after the words" increased pressure'.
42. In Annex 1, point 3.1.2, fourth sentence, the words "or organisation referred to in § 6c 'are inserted after the words" authorised person', and in the fifth sentence, the words "or organisation referred to in § 6c 'are inserted.
43. In the second sentence of point 3.1.3 of Annex 1, the words "authorised person 'are replaced by the words" organisation according to § 6c'.
44. In Annex 1, paragraph 3.2.3, "2.11 'is replaced by" 2.10'.
45. In Annex No 1, point 3.3.1, the words "or, in the case of the CE marking, Article 7a 'shall be inserted after the words" pursuant to Paragraph 5 (6)'.
46. In Annex 1, point 3.3.1 (b) (1), "litres' is replaced by" L (litres) '.
47. in Annex 1, point 3.3.1 (b) (8), the symbol "kg / l" is replaced by the symbol "kg / L."
48. In Annex 1, point 3.3.2, the words "or, in the cases referred to in Section 7a of the CE marking 'shall be inserted after the words" Czech conformity mark'.
49. in the second sentence of point 3.3.2 (a) of Annex 1, the words "or, in the cases referred to in Section 7a of the CE marking" shall be inserted after the words "the Czech mark of conformity."
50. in Annex 1, point 3.4 (a) (4), the words "and tests" shall be inserted after the words "including checks."
51. in Annex 1, point 4.2 (b) (2), the words "or, in the case of Section 7a (1), the European approval for materials" shall be inserted after the words "the material certificate referred to in Section 4";
52. In Annex 1, point 4.2 (c), the words "(b) (point) 'are inserted after the words" point 4.2 (b)'.
53. In Annex 1, point 7, the words "harmonised standards' are replaced by the words" technical standards referred to in Section 2 (2) 'and the words "or importer' are deleted.
54. In Annex 1, point 7.1.1, first sentence, the symbol "Re / t 'is replaced by the symbol" ReT'.

product quality assurance (E1 conformity assessment procedure).
For category III:
EC design examination and quality assurance (conformity assessment procedures B1 + D),
EC design examination and verification of product quality (conformity assessment procedures B1 + F),
EC type-examination and product quality assurance (conformity assessment procedures B + E),
EC type-examination and conformity with type (conformity assessment procedures B + C1); or
comprehensive quality assurance (conformity assessment procedure H).
For category IV:

63. In Annex No 2, point 3 (b), "DN or 'is replaced by" DN as appropriate'.
64. In Annex 2, point 4:
"4. In the following conformity assessment graphs, the separation line indicates the upper limit for the lower category.

65. In Annex 3 (1), in the title, "Conformity assessment by the manufacturer or importer 'is replaced by" Internal control of production'.
66. In Annex 3 (1) (1), point 1 reads as follows:
"1. Internal production control shall be the procedure whereby the manufacturer or, where appropriate, the authorised representative who fulfils the obligations set out in point 2 ensures and declares that pressure equipment complies with the provisions of this Regulation which apply to them. The manufacturer or, where applicable, the authorised representative shall place the CE marking on each pressure equipment and issue a written EC declaration of conformity in the cases referred to in Article 7a. ';
67. In Annex 3 (1), the following points 2 and 3 are inserted after point 1:
'2. The manufacturer shall draw up the technical documentation referred to in point 4 and, where applicable, the manufacturer or the authorised representative shall keep it for 10 years after the last pressure equipment of the type concerned has been manufactured.
3. The manufacturer or authorised representative shall keep a copy of the certificate of conformity together with the technical documentation. ';
Points 2 and 3 shall become points 4 and 5.
68. In Annex 3 (1) (4), the words "requirements of this Regulation 'are replaced by the words" provisions of this Regulation' and the words "harmonised standards' are replaced by the words" technical standards referred to in Article 2 (2) '.
69. In Annex 3 (2), in the title, the words "Conformity assessment by a manufacturer or importer with random checks authorised by a person 'are replaced by the words" Internal control of production with supervision of final assessment', the words "referred to in point 1 'are replaced by the words" Conformity assessment A' and the words "or importer 'are deleted.
70. in Annex 3 (2) (a), the words "or importer" shall be deleted;
71. In Annex 3, at the end of paragraph 2, the following sentence is added: "The authorised person shall ensure that the manufacturer's identification number is marked with each pressure device. ';
72. In Annex 3 (3), in the title, "Type examination 'is replaced by" EC type examination'.
73. In Annex 3 (3) (1), the words "the requirements of this Regulation 'are replaced by the words" the provisions of this Regulation which apply to them'.

80. In Annex 3 (3) (3), point (g) is deleted.
Point (h) shall be renumbered as point (g).
81. In Annex 3 (3) (4.1), the words "harmonised standards' are replaced by the words" technical standards referred to in Article 2 (2) 'and the words "those standards' are replaced by the words" technical standards referred to in Article 2 (2) '.
82. In Annex 3, paragraph 3, point 4.1 (b), the words "harmonised standards or material certificates" are replaced by the words "technical standards referred to in Article 2 (2) or material certificates, or, in the case of Article 7a, European approval for materials," and in point 4.2, the words "harmonised standards" are replaced by the words "technical standards referred to in Article 2 (2)."
83. In Annex 3 (3) (4.3), the words "applied standards' are replaced by the words" applied technical standards under Paragraph 2 (2) '.
84. In Annex 3 (3) (4.4), the words "or authorised representative 'shall be inserted after the word" manufacturer'.
85. In Annex 3 (3) (5), the first sentence shall read: "If the type corresponds to the requirements of this Regulation, the authorised person shall issue to the manufacturer or, where appropriate, to the authorised representative an EC type-examination certificate or an importer a type-examination certificate. '.
86. In Annex 3 (3) (5), the fourth sentence is: "If the authorised person refuses to issue a type-examination certificate or, in the case of § 7a of the EC type-examination certificate, he shall give detailed reasons. '.
87. In Annex 3 (3) (6), the words "type-examination certificate 'are replaced by the words" type-examination certificate or, in the case of Section 7a, EC type-examination certificate'.
88. in Annex 3 (3), the following points 7.1, 7.2, 8.1, 8.2 and 9 are added:
"7.1. Each authorised person shall communicate to the Authority the relevant information on the EC-type examination certificates which he has withdrawn and, on request, information on the certificates which he has issued.
Each authorised person shall also communicate to the other competent authorised persons the information relating to the EC-type examination certificates which it has withdrawn or refused.
8.1 The Office and other authorised persons may receive copies of EC type-examination certificates and additions thereto. The annexes to the certificates shall be made available to the Office and other relevant authorised persons.
9. The manufacturer and, where appropriate, the authorised representative shall, together with the technical documentation, keep copies of the EC type-examination certificates and their additions for a period of 10 years after the production of the last pressure equipment of that type. ';
89. In Annex 3 (4), in the title, "Assessment of conformity of pressure equipment with the essential requirements authorised by the person at the design stage 'is replaced by" EC design examination'.
90. In Annex 3 (4) (1), "requirements' is replaced by" provisions of this Regulation '.
91. In Annex 3, paragraph 4, point 2, the words "or authorised representative 'shall be inserted after the words" manufacturer'.
92.In Annex 3 (4) (2) (a), the words "or authorised representative" shall be inserted after the word "manufacturer."
93. In Annex 3 (4) (2) (b), the word "type 'is replaced by" design or, in the case referred to in Section 7a, EC design examination'.
94. In Annex 3 (4) (3) (d), the words "harmonised standards' are replaced by the words" technical standards referred to in Article 2 (2) 'and the words "harmonised standards' are replaced by the words" technical standards referred to in Article 2 (2) '.
95.In Annex 3 (4) (3) (e), the words "harmonised standards" are replaced by the words "technical standards referred to in Article 2 (2)" and the words "or authorised representative" are inserted after the word "manufacturer."
