on technical and rescue equipment for seagoing yachts and proving competence to conduct seagoing yachts
The Ministry of Transport and Communications provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on Maritime Navigation ("the Act ') for the implementation of the provisions of § 13 (3) and § 49 (5) of the Act:
Subject matter
This decree provides
(a) required technical and rescue equipment for seagoing yachts;
(b) the definition of the areas authorised for seagoing yachts with a limitation of the distance between seagoing yachts from land or coast;
(c) details of the method of proving the practice, the examination committee and the conduct of the tests;
(d) the knowledge requirements of the applicant;
(e) the species, models, validity, scope of the licence to conduct the sea yacht and the conditions for its issue;
(f) the validity of licences previously issued.
AREAS AUTHORIZED BY MARITIME VESSELS OF MARITIME YACKS AND THE TECHNICAL AND SAFETY EQUIPMENT OF MARITIME YACKS
DETERMINATION OF THE MARITIME LANGUAGE VESSELS AUTHORIZED
For seagoing yachts ("yacht '), the following areas of authorised seagoing (" sailing area') are defined:
(a) sailing area I includes the range of sea sailing yachts without limitations of sailing,
(b) the area of navigation II shall include the sea-going of yachts with a limited voyage within 200 nautical miles of the shore line of land or coast determined by the mean tidal height (hereinafter referred to as the "coastal line");
(c) the area of navigation III shall include the sea-going of yachts with a limited voyage within 20 nautical miles of the coastal line;
(d) the area of navigation IV shall include the seagoing sailing of yachts with a limited voyage within 3 nautical miles of the coastal line;
(e) sailing area The V includes a seagoing sailing yacht with a limitation up to 0,75 nautical miles from the coastal line.
REQUEST TECHNICAL AND SAFEGUARD EQUIPMENT OF THE YAY TO THE MARINE VESSELS
Technical equipment required
(1) The required technical equipment for sea-going yachts is:
(a) signalling equipment;
(b) fire-fighting equipment;
(c) navigation equipment;
(d) radio equipment;
(e) on-board equipment.
(2) The technical equipment referred to in paragraph 1 must be in a state eligible for use according to its destination and in accordance with the international treaties by which the Czech Republic is bound and which have been published in the Collection of Laws (hereinafter referred to as the "International Treaties by which the Czech Republic is bound") .1.
Signalling equipment
The yacht must be equipped
(a) navigation lights;
(b) daily signs,
(c) equipment for the provision of audible signals;
(d) by pyrotechnic means with a marked period of validity, for sailing areas I and II, of at least 6 red flares or torches and 1 smoke orange signal; for navigation zones III, IV and V of at least 3 red flares or torches,
(e) a watertight electric lamp, which is designed to be indicated by the Morse alphabet, a replacement filament lamp and a set of spare batteries in a watertight container,
(f) a search lamp suitable for use in manoeuvring and rescue operations;
(g) a radar reflector.
Fire-fighting equipment
(1) The yacht must be equipped with:
(a) a portable fire extinguisher prepared for intervention and stored in appropriate holders; the load mass shall be at least 2 kg and shall not exceed 6 kg;
(b) a fire bucket of 5-10 litres with a rope of length which allows water to be collected from the deck;
(c) fire axe.
(2) A yacht without a built-in engine with a total hull length of more than 12 metres shall be equipped with 2 portable fire extinguishers complying with the requirements referred to in paragraph 1 (a).
(3) The yacht fitted with an engine must be equipped with other portable fire extinguishers of the filling mass specified in Annex 1.
(4) A yacht of a total hull length of more than 12 metres shall be equipped with 2 fire-extinguishers meeting the requirements referred to in paragraph 1 (b).
Navigation equipment
(1) The yacht must be equipped with:
(a) an illuminated magnetic compass with a compass deflection table, located in such a way that it is clearly visible from the seat of the helmsman;
(b) by telescope;
(c) sea maps and publications relating to the sailing area of the yacht, as amended by all valid corrections.
(2) A yacht whose technical seagoing capacity has been approved for navigation I or II shall be equipped with:
(a) an optical measuring device or a hand-held aiming compass;
(b) chronometer or clock accuracy;
(c) astronavigation tables for determining the geographical location of the yacht;
(d) stoppers,
(e) a yacht speed measuring instrument;
(f) sextant,
(g) aneroid,
(h) tools for working on the map.
(3) A yacht whose technical seagoing competence has been approved for navigation III shall be equipped with an optical gauge or manual targeting compass.
Radio equipment
(1) The yacht must be equipped with a radio-telephony enabling connection in the range of very short waves.
(2) A yacht whose technical competence for maritime navigation has been approved for navigation I or II shall be equipped with a receiver for receiving information on maritime safety and emergency radio equipment determining its position in global maritime emergency and safety systems (COSPAS-SARSAT, GMDSS).
(3) A yacht whose seagoing capacity has been approved for navigation III must be equipped with a receiver for receiving information on maritime safety.
On-board equipment
(1) The yacht must be equipped with:
(a) anchorages;
(b) two hooks,
(c) two binding ropes,
(d) fixed ropes attached to the hull so that they can be released quickly by hand, by knife or by scissors;
(e) two reflectors on each side of the yacht,
(f) by a manual water pump,
(g) a tow rope of a length of at least 2 length of the yacht,
(h) by throwing wire,
(i) a safety rope on both sides of the yacht,
(j) first aid kit in waterproof packaging;
(k) spare parts for repairs;
(l) a set of basic tools,
(m) containers for sorting waste.
(2) At the yacht, a procedure shall be posted at an accessible location to determine the method of disposal of the yacht at sea. The model of the label is set out in Annex 2.
Required rescue equipment
(1) The yacht must be equipped with:
(a) two life-saving rings or bobbins marked with the name of the yacht and the name of the register port, located on both sides of the yacht with an easily accessible and rapidly released attachment;
(b) lifejackets in numbers corresponding to the number of persons on a sea-going yacht.
(2) One life-cycle or horseshoe shall be provided with a floating life-rope of the smallest length of 20 metres. The second life cycle or horseshoe shall be equipped with a self-digestion light or combined light-smoke buoy.
(3) A yacht whose seagoing capacity has been approved for navigation I or II shall be equipped with a life raft which shall carry persons in the number indicated on the register.
(4) A yacht whose seagoing capacity has been approved for navigation III or IV shall be equipped with a buoyancy-chamber boat which shall carry persons in the number of persons declared in the register, even when fully watered with water.
(5) A yacht whose seagoing capacity has been approved for navigation I, II, III or IV must be equipped with a safety-belt with rope. For the sailing area I, II or III, the number of safety belts shall correspond to at least half of the persons on the yacht for sea navigation.
(6) The emergency equipment required must be in a state of use as intended and in accordance with the international treaties by which the Czech Republic is bound. 1)
PROHIBITION OF ELIGIBILITY TO LEAD A MARITIME YACHER
SPECIES, SAMPLES AND SCOPE OF THE CERTIFICATE OF ELIGIBILITY TO LEAD THE MARITIME YACHT
(1) The types of seagoing yacht licences (the "licence") are distinguished according to the scope of the authorisation:
(a) A licence shall include the seagoing sailing of yachts without limitation of navigation;
(b) the entitlement card B shall include the seagoing voyage of a yacht with a limited sailing distance of 200 nautical miles from the coastal line;
(c) the authorisation card C shall include the seagoing voyage of a yacht of a maximum hull length up to 16 m with a navigation limit of 20 nautical miles from the coastal line, provided that the wind force does not exceed 6 degrees of Beaufort scale.
(2) The holder of the licence shall be entitled to conduct the yacht on seagoing voyages under the licence indicated on the licence.
(3) According to the type of propulsion of the yacht for which the licence is intended, the Maritime Authority (hereinafter referred to as the Office) shall indicate in the licence "restricted to motor yachts' or" without limitation '.
(4) The model of the licence is set out in Annex 3.
(5) The Office shall keep records of the cards.
CONDITIONS FOR ISSUING TRANSPORT
(1) The Office shall issue a licence on the basis of a written request for the issue of a licence.
(2) The licence application must be accompanied by:
(a) a certificate of successful test;
(b) proof of sailing experience;
(c) a valid medical certificate which is not more than 3 months old;
(d) a colour photograph of 3,5 cm x 4,5 cm, corresponding to the applicant's actual appearance;
(e) proof of payment of the administrative fee, 2)
(f) a copy of the valid licence if the applicant holds it.
Issue of licences
A card with authorisation C shall be issued to a natural person who:
(a) has demonstrated professional competence to conduct a yacht by passing a successful test and experience on a yacht of at least 100 nautical miles' length under the supervision of the master of the yacht;
(b) has demonstrated fitness to conduct a yacht;
(c) has reached the age of 18;
(d) is eligible for legal action;
(e) has paid the administrative payment.2)
A card with entitlement B shall be issued to a natural person who:
(a) holds a valid C-licence;
(b) has demonstrated competence to conduct a yacht by passing a successful test and experience on a yacht of at least 1 000 nautical miles as master of the yacht and at least 1 500 nautical miles at a distance of more than 20 nautical miles from the coastal line under the supervision of the master of the yacht;
(c) has demonstrated fitness to conduct a yacht;
(d) has paid the administrative payment.2)
Authorisation card A is issued to a natural person who
(a) holds a valid B licence;
(b) has demonstrated competence to conduct a yacht by successfully passing a test and experience on a yacht of at least 5 000 nautical miles on a sea voyage, at a distance of more than 20 nautical miles from the coastal line as master of the yacht;
(c) has demonstrated fitness to conduct a yacht;
(d) has paid the administrative payment.2)
TEST COMMISSION, TESTS AND REQUIREMENTS FOR NOTIFICATION OF APPLICANT
The test to demonstrate the competence to conduct a sailing yacht (hereinafter referred to as "the test ') shall be composed of at least four test committees, the chairman of which shall direct the work of the commission and the other members of the examination committee shall be appointed by the Office.
(1) The expert commissioner authorised to verify the expertise referred to in Paragraph 18 (1) may be the person who is competent in such expertise.
(2) The examination commissioner authorised to verify the expertise referred to in Paragraph 18 (2) (hereinafter referred to as the yacht instructor) may be the person holding a valid A or B licence.
(3) The examination commissioner authorised to verify knowledge from the basis of the provision of first aid may be:
(a) a doctor,
(b) a senior medical professional in the field of a certified general nurse, a certified child nurse or a certified midwife;
(c) a health care professional in the field of medical care, general nurse, pediatric nurse, midwife, nurse, female nurse or intensive care nurse; the condition is that, since their active activity, the doctor has not given up a period of 5 years and 2 years for other health professionals.
(1) The test for obtaining a C-approved licence shall verify theoretical and practical knowledge in accordance with Section 18.
(2) The examination of the A or B licence shall verify the theoretical knowledge referred to in Article 18 (1).
(1) Required theoretical knowledge:
(a) the foundations of maritime law and the international treaty, which the Czech Republic is bound by and which has been published in the Collection of Laws (hereinafter referred to as the rules on preventing collisions at sea), 3)
(b) sailing lessons
1. in the control of sailing yachts equipped with motor propulsion, if the licence is intended to lead yachts without restriction; or
2. control of motor yachts without rinsing, if the licence is to be restricted to the management of motor yachts,
(c) maritime navigation;
(d) meteorology;
(e) the basic English;
(f) the basis for providing first aid.
(2) The thematic headings of the test questions verifying the required theoretical knowledge referred to in paragraph 1 are set out in Part A of Annex 4 to this Decree.
(3) Required practical knowledge to be verified on a yacht at sea:
(a) preparation for navigation;
(b) manoeuvring with a yacht;
(c) sailing,
(d) dealing with emergency situations.
(1) The examination shall be carried out on the basis of a completed application by a natural person (hereinafter referred to as "applicant") submitted to the Office. The model of the application is set out in Annex 5.
(2) Within 15 days of the date of receipt of the application, the applicant will be informed of the date of the examination.
(1) The test is composed in the Czech language.
(2) A candidate may only proceed to the verification of theoretical knowledge after the verification of practical knowledge by a yacht instructor, if the verification of practical knowledge is required. The yacht instructor shall report in writing to the other members of the examination committee on the progress of the verification of the practical knowledge of the candidate.
(3) The knowledge of the expertise referred to in Paragraph 18 (1) shall be verified by oral examination after a successful previous written role from maritime navigation. In the oral examination, the applicant shall answer five questions from each expert according to the type of professional competence that the tenderer demonstrates.
(4) Details of the conduct of the test shall be laid down in the test schedule set out in Part B of Annex 4 to this Regulation.
If the tenderer has demonstrated the required knowledge in dealing with theoretical and practical tasks, it is assessed by the classification step, otherwise it has failed the classification step. The candidate shall also be evaluated in the classification step if he did not show up for the test or resigned during the test without a proper apology.
The successful test certificate shall be issued on the day of the oral examination of the knowledge referred to in Article 20 (3) to the candidate evaluated by the classification grade. The certificate shall bear the following particulars:
(a) the name, surname and birth number or date of birth of the tenderer;
(b) the number of the certificate;
(c) an indication of the type of licence for which the tenderer has demonstrated competence;
(d) the date of issue of the certificate and the signature of the Chairman of the Examination Board.
A candidate evaluated by the classification grade shall be granted a test panel to issue evidence of proven expertise in accordance with Paragraph 18, which will no longer be verified in a repeat test carried out after 2 months.
