Decree of the Ministry of Agriculture on the labelling and registration of horses, pigs, runners and farmed game and on the registration of poultry, breeding fish and bees

on the marking and registration of horses, pigs, runners and farmed game and the registration of poultry, breeding fish and bees
The Ministry of Agriculture provides pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act) (hereinafter referred to as "the Act") for the implementation of Sections 22 (3) and 23 (7) of the Act:

DÍL 1

GENERAL PROVISIONS
§ 1
Basic concepts
(1) For the purposes of this decree:
(a) holding - an operating unit of one breeder with at least one stable with one or more categories of horses, pigs, runners, (1) farmed game, poultry, breeding fish or bees situated in the perimeter of one municipality, in territorial subdivided statutory towns and in the capital of Prague situated in one urban district or in one urban area;
(b) stables, in the case of breeding fish, tanks and at the place of the bees - any construction, establishment, place or part thereof within a holding where horses, pigs, runners, farmed game, poultry, breeding fish or bees are concentrated;
(c) the movement of the animal - the movement of the animal between different holdings of the same breeder, the movement to another breeder, the movement to another breeder, the introduction or sale of the animal to a legal or natural person holding horses, pigs, runners, poultry, breeding fish or farmed game for the purpose of their sale ("trader") or the movement to a slaughterhouse operator or the movement of the animal to a legal or natural person whose activity is the collection, collection, collection, disposal and further processing of confiscation of animals of animal origin, 3) ("rendering establishment"); the movement of the animal between different stables within the same holding (hereinafter referred to as "the movement of the animal between stables') is not considered to be a transfer;
(d) movement of hives - any movement of hives away from the site;
(e) the identification number of the animal, with the exception of the horse - a maximum of 12 digits, allowing identification of the particular animal;
(f) identification number of the horse - no more than a 15-digit alphanumeric code which allows identification of the particular horse and which contains:
1. in the first three places the country code - number "203" for the Czech Republic,
2. at the following three places, the alphanumeric code of the recognised breeding association which first registered the horse in the horse registration book,
3. in the last nine places, the registration number of the horse in the database of a recognised breeding association which first registered the horse in the horse registration book;
(g) the registration number of the holding, bee-keeper, merchant, slaughterhouse or rendering plant - no more than a 12-digit number series allowing identification of the specific holding, bee-keeper, merchant, slaughterhouse or rendering plant.
(2) Animals from the original holding shall also be considered to have been grazing animals on permanent grassland during the grazing season, (4) situated in the perimeter of neighbouring municipalities or adjacent military depots.

NOTIFICATION OF HORSES, PRACTICES, TRAVELS AND VERIFICATION IN FARM FARM FARM
(Paragraph 22 (3) of the Law)

Common provisions
§ 2
Identification means
(1) For the labelling of horses, pigs, runners and farmed game they are used
(a) plastic ear tags,
(b) tattoos,
(c) fires;
(d) plastic wing stamps,
(e) word and graphic description.
(2) The marking of a means of identification other than that referred to in paragraph 1 or by any other means resulting from the implementation of veterinary prevention or breeding measures shall not interfere with or be interchangeable with the marking provided for in this Order.
(3) Identification devices cannot be used repeatedly for labelling.
(4) The means of identification may be removed or removed from the animal only after the death or death of the animal. After removal from the animal, the identification device shall be disinfected and degraded so that it cannot be reused. Identification means shall be taken if:
(a) death or death of the animal, at the establishment of the rendering establishment;
(b) the slaughter of the animal, after ensuring the identity of kus5) at the slaughterhouse establishment;
(c) domestic slaughter (6) of pigs, runners, farmed game (where appropriate) or destruction (7) of the dead or culled animal ("carcases") on the holding.
(5) Upon request, the person responsible for managing the central register shall dispose of the means of identification used and surrendered.
§ 3
General requirements for ear and wing tags
(1) The plastic ear and wing tags must be:
(a) made of wear-resistant material;
(b) made up in such a way that their shape and structure:
1. have been designed to be hung in the animal's earache or in the animal's wing;
2. minimise the pain and possibility of injury to the animal,
3. ensure permanent attachment to the animal,
4. do not allow re-use;
(c) unchangeable, unmistakable and easily readable throughout the life of the animal;
(d) marked with alphanumeric characters which cannot be removed.
(2) Ear and wing tags used for one animal must differ in their shape or size or colour from those used for another animal.
(3) Pliers are used to hang ear and wing marks. Before hanging the ear or wing marks, parts of the insert (s) which come into contact with the tissues of the animal, the ear or wing marks to be hung and the place of suspension shall be disinfected.
(4) Where an ear or wing tag is lost or damaged which makes it impossible to identify the animal, or where the alphanumeric data referred to therein become illegible, the breeder shall immediately notify the relevant person responsible for the central registration, who shall provide the breeder with a duplicate of the ear or wing tag. The duplicate of an ear or wing mark shall contain data identical to that given on the original means of identification, if it is a duplicate of the means of identification of an animal imported from abroad, at least the country code and the identification number of the animal.

Identification of horses
§ 4
Means of identification of horses
(1) Horses are marked
(a) a verbal and graphic description, specifying the genetic type; or
(b) word and graphic description and firing.
(2) Breeding horses shall be identified by the methods referred to in paragraph 1 according to the order of the herd-books of horses. 8)
(3) Where horses not registered in herd books are marked with word and graphic description and fire, this fire shall be carried out in the right saddle landscape of the horse and shall consist of two parts: the upper part of the saddlebook of the horse shall be ignited and the lower part of the saddle landscape shall be ignited in the horse registration book. The upper number shall be not more than two-digit, the lower number shall be not more than three-digit. The numbers shall be between 35 and 40 mm. The ignition shall be located in the right-hand seat landscape so that the upper edge of the upper row numbers is on the palm of the centre line of the spine. The last number of the lower row shall be located in the palm width from the rear edge of the scapula.
(4) Each foal shall be marked before weaning and no more than 8 months after birth.
(5) The verbal description of the horse shall include a description of the basic colour and a description of the congenital badges characterising the head, neck, limb and body of the horse in a manner determined by the person responsible for the central registration of the horse.
(6) The graphical description of the horse shall include a drawing of congenital and acquired badges and hair vortices characterising the horse's body (left and right), head, neck and breast from a ventral viewpoint, head and nose from an oesophagus point of view, front and back legs in a manner determined by the person responsible for leading the central registration of the horse.
(7) If there are changes on the horse which do not agree with his word and graphic description on the horse card or in the horse register, the owner of the horse shall ensure repair of the person who carries out the horse marking for the relevant recognised breeding association (hereinafter referred to as the "horse marking person ') or the veterinarian who makes a change to the word and graphic description in the horse card and on the registration card, which shall be sent within 7 days of the date of entry of the repair to the person in charge of the central horse registration.
§ 5
Method of identification of horses imported from abroad
Horses imported from abroad which do not accompany a horse's identification issued in accordance with European Community9) and containing a verbal and graphic description of the horse shall be marked no later than the time of the end of the quarantine, except for horses imported to participate in animal welfare, 2), and
(a) only by word and graphic description with a genetic type designation; or
(b) a word and graphic description if they are already marked by a height.
If further movements of horses imported into the sedition2) are carried out, these horses shall also be identified by word and graphic description, specifying the genetic type, at the latest until the end of the quarantine.

Labelling of pigs
§ 6
Means of marking pigs
(1) Any pig whose marking is required by the breeder (§ 22 (1) and (2) of the Act) must be marked with a tattoo in the left ear or flat tattoo on the left side of the body or with an ear stamp in the left ear at the latest before leaving the holding in which it was born.
(2) In the case of breeding pigs, their individual marking according to the rules of the pig herd book (8) shall not interfere with the marking referred to in paragraph 1.
§ 7
Tattoo of pigs
(1) The tattoo of pigs must contain a maximum of four-digit alphanumeric code, which indicates the registration number of the holding where the pig was born.
(2) The method of marking pigs by tattoo is given in Annex 1.
§ 8
Ear tags used for marking pigs
(1) For the marking of pigs, plastic ear tags shall be used, which shall be at least 34 mm high, at least 25 mm wide and the height of the alphanumeric characters indicated therein shall be at least 4 mm high.
(2) The plastic ear tag used for marking pigs must contain:
(a) country code - letters "CZ" for the Czech Republic,
(b) the registration number of the holding on which the pig was born;
(c) the graphical character (logo) of the person responsible for the central pig register.
(3) The model of the plastic ear tag used for marking pigs and the method of suspension thereof is set out in Annex 1.
§ 9
Means of labelling pigs imported from abroad
(1) Pigs imported from abroad onto the holding shall be identified in the manner referred to in paragraphs 6 to 8 at the latest before leaving the holding to which they were imported, except for pigs imported to participate in the dispatch of animals. (2) Where pigs imported into the dispatch of animals are further moved, (2) they shall be marked as referred to in paragraphs 6 to 8 at the latest before leaving the holding to which they were introduced.
(2) Pigs imported from abroad directly to the slaughterhouse shall be left with the original marking.

Cross-country marking
§ 10
Method of identification of runners
Each chicken must be marked before leaving the holding, but no later than 6 weeks after hatching by a wing mark inserted into the right wing fold.
§ 11
Weighing more than 150 g / m2
(1) For the marking of runners, plastic wing tags shall be used, which shall be at least 50 mm high, at least 43 mm wide and the height of the alphanumeric characters indicated therein shall be at least 5 mm high.
(2) The chalk mark used for the marking of runners must contain:
(a) country code - letters "CZ" for the Czech Republic,
(b) identification number of the animal,
(c) the graphic character (logo) of the person in charge of the central register of runners.
(3) The model of the plastic wing tag used for the marking of runners and the method of its suspension is set out in Annex 2.
§ 12
Means of identification of runners imported from abroad
Trainers imported from abroad shall be identified in the manner set out in Sections 10 and 11 within 72 hours from the date of crossing the national border, with the exception of those imported to participate in the segregation of animals. (2) If there is a further transfer of runners imported into the shed of animals, (2) they shall be marked as described in Sections 10 and 11 within 72 hours of leaving the point of contact of the animal.2)

Farm game labelling
§ 13
Method of labelling farmed game
Each farmed animal must be permanently marked,
(a) if the deer and muflon are present before leaving the holding in which he was born, no later than 72 hours after birth, one ear tag in the left earache;
(b) if the pig is wild, in accordance with § 6 to 9.
§ 14
Ear tags used for labelling deer and muflon
(1) Plastic ear tags shall be used for the marking of deer and muflon, which shall be at least 35 mm long, at least 9 mm wide and the height of the alphanumeric characters indicated therein shall be at least 5 mm high.
(2) The ear tag used for the labelling of deer and muflon shall contain:
(a) country code - letters "CZ" for the Czech Republic,
(b) identification number of the animal,
(c) the graphic character (logo) of the person responsible for the central register of farmed game.
(3) Ear tags are hung to the root of the earache (between the skin eyelashes of the bolus).
(4) The model of the plastic ear tag used for the marking of deer and muflon and the method of its suspension is set out in Annex 3.
§ 16
Means of marking farmed game imported from abroad
Farmed animals imported from abroad shall be identified as referred to in Sections 13 and 14 within 72 hours from the date of crossing the national border, except farmed game imported to participate in the dispatch of animals. (2) If further movement of farmed game imported to participate in the segregation of animals occurs, (2) these animals shall be identified as referred to in Sections 13 and 14 within 72 hours of leaving the seed.2)

EQUIVALENT OF HORSE, PIGS, CURRENT, FARM FISH, PULL FISH AND INCLUDING
(Paragraph 23 (7) of the Law)

Common provisions
§ 17
(1) The breeder, with the exception of the bee breeder, the trader, the slaughterhouse operator or the rendering operator, shall register with the relevant person responsible for the central register (10) with a registration form, the specimen of which appears in Annex No 4, within 7 days of becoming a breeder, trader, slaughterhouse operator or rendering operator. In the case of a horse breeder, a breeder holding a horse in his own stable or in his own stable shall register with the person in charge of the horse's central register. In the case of poultry breeders, a breeder holding more than 100 poultry of one species shall register with the person responsible for the central poultry register. The bee keeper shall register with the person in charge of the central register of bees at the same time as sending the first notification of the number of hives and the location of habitats (§ 56).
(2) If the breeder, with the exception of a bee breeder, a trader, a slaughterhouse operator or an rendering operator, terminates his activity, he shall notify the relevant person responsible for the central register (10) within 7 days of the date on which the event occurred. The model of the closure notification is set out in Annex 4. The bee-keeper shall notify the cessation of activity at the same time as the notification of the number of hives and the location of habitats (§ 56).
(3) The list of persons responsible for the central register of horses, pigs, runners, farmed game, poultry, breeding fish and bees is published in the Ministry of Agriculture Bulletin.
§ 18
(1) The register of animals on the holding (Sections 19, 29, 38 and 43), the stables register (Section 33), the catch book and the chamber book (Section 51) and the Habitats Register (Section 55) may also be maintained in the form of a computerised database following the approval of the computer programme by the responsible person responsible for the central register (10). The register of animals on the holding, the stables, the fishing and the chamber book and the habitat register shall, after printing, contain the information set out in this decree in the same order as on the form provided by the competent person responsible for the central register. 10)
(2) Reporting on hatching or birth of animals, their mortality, loss and transfer (§ 30, 34 and 39), the number of adult poultry (§ 45), the monthly production of the purchase and sale of hatching eggs and pups (§ 47), the number of breeding fish (§ 52) and the number of hives and the location of habitats (§ 56), may also be sent by the responsible person responsible for managing the central register (10), after printing, to the data set out in this decree in the same order as the form provided by the relevant person responsible for the central register. 10)

Horse records
§ 19
Register of horses on the holding
(1) For each holding, the horse breeder holding the horse in his own or rented stable shall keep a register of horses on the holding. Each register of horses on the holding shall bear:
(a) the name and surname or name of the breeder;
(b) the registration number of the holding;
(c) the address of the holding.
(2) The register of horses on the holding shall be registered for each horse kept on the holding:
(a) the identification number of the horse;
(b) the name of the horse;
(c) sex;
(d) the jurisdiction of the herd-book where it is registered;
(e) the name and surname of the owner;
(f) movement of the animal, with registration
1. date of transfer; and
2. the registration number of the holding, trader, establishment or establishment of the slaughterhouse or establishment of the rendering establishment, from where or where the animal has been moved, or the place of dispatch of the animals, (2) or, where applicable, the country code, if any, of the animal imported or exported.
(3) In addition to the data referred to in paragraphs 1 and 2, checks carried out by the competent authorities of the State control shall be recorded in the register of horses on the holding, the date of the inspection, the name and surname of the person carrying out the inspection and the name of the State control authority.
(4) The register of horses on the holding shall be kept in writing by the breeder on forms provided by the person responsible for managing the central register of horses. The model of the equine register on the holding is set out in Annex 5.
§ 20
Registration of horses with a permit
(1) At birth, the foal, with the exception of the foal of the English purebred and glider, shall, within 14 days of birth, be sent by the owner to the person carrying out the marking of the horses by the third admission note from the admission register.
(2) On the basis of the third admission note, the person responsible for marking horses shall enter the foal in the horse registration book. When marking a horse, that person shall complete the fourth admission note provided by the owner and send it to the person in charge of the central register of horses, where appropriate through a recognised breeding association.
(3) At the time of birth, the foal of the English purebred and glider shall be sent by its owner within three weeks of the date of birth to the person responsible for managing the central register of horses. The word and graphic description of the foal shall be provided by the person responsible for managing the central equine register and, where appropriate, by the veterinarian at his request. The completed foal identification card shall be sent to the person authorised to verify and certify the origin and identification of the genetic type of breeding animals, who shall enter the laboratory number of the test in the foal identification card, 11) who has established the genetic type of the foal, and the card shall be sent to the person responsible for the central register of horses. The model of the foal identification card is given in Annex 6.
(4) Where the horse is marked with a verbal and graphic description, specifying the genetic type, the owner of the horse shall also send a certificate of genetic type determination to the person in charge of the central registration of the horse.
§ 21
Registration of horses without a permit
(1) The person carrying out the identification of horses shall complete the registration report of the horse and enter it in the horse registration book.
(2) The complete registration report of the horse shall be sent by the owner to the person responsible for carrying out the horse registration without delay.
(3) The model for the registration of a horse provided by the owner by the person responsible for managing the central register of horses is set out in Annex 7.
(4) Where the horse is marked with a verbal and graphic description, specifying the genetic type, the owner of the horse shall also send a certificate of genetic type determination to the person in charge of the central registration of the horse.
§ 22
Registration of imported horses
(1) Following the end of the quarantine of horses imported from abroad, with the exception of horses imported to participate in the dispatch of animals, (2) (hereinafter referred to as "permanent importation of horses"), the owner or, where appropriate, through the person carrying out the marking of horses, shall send a report of the permanent importation of the horse to the person in charge of the central register of horses. The permanent import report of a horse shall be sent on a form to be provided to the owners by the person in charge of the central register of horses. The model of the permanent import report for the horse is set out in Annex 8. The word and graphic description of the horse which is part of the report on the permanent importation of the horse shall be completed by the person carrying out the identification of the horse.
(2) (9) The owner shall send a report on the permanent importation of the horse to the person in charge of the central registration of the horse and the identification of the horse if the horse is permanently imported. The person responsible for managing the central equine record shall register the horse and, where appropriate, complete its verbal and graphic description and identification of the horse within 7 days of its arrival, send it back to the owner.
(3) (9) The owner shall send a report of the permanent importation of the horse and a copy of the certificate of origin to the person in charge of the central registration of the horse, unless the horse is permanently imported. On the basis of that registration, the person in charge of the central horse registration shall issue a horse passport to horses born after 31 December 1997.
(4) If the horse permanently imported is not accompanied by a horse identification card issued in accordance with European Community rules (9) or a certificate of origin, the owner shall send a permanent import report to the person responsible for carrying out the horse marking. On the basis of that registration, the person in charge of the central horse registration shall issue a horse passport to horses born after 31 December 1997. The person tagging the horses shall enter the horse in the horse registration book.
(5) The report on the permanent importation of a horse, a horse passport or a copy of the certificate of origin shall be sent to the person responsible for the central registration of a horse within 7 days of the date of the end of quarantine of the permanently imported horse.
(6) Where the horse is marked with a verbal and graphic description, specifying the genetic type, the owner of the horse shall also send a certificate of genetic type determination to the person in charge of the central registration of the horse.
§ 23
Horse Registration Book
(1) Any person carrying out the marking of horses, not including an English purebred and glider, shall keep a register of horses; the horse registration book shall be kept in writing on forms provided by the person responsible for managing the central equine registration. The model of the horse registration book is set out in Annex 9.
(2) Each horse registration book shall bear:
(a) the name and surname or name of the person carrying out the marking of horses and their permanent residence or registered office;
(b) the calendar year for which the registration book is kept;
(c) the maximum two-digit registration number of the horse registration book allocated to it by the person in charge of the central register of horses.
(3) The registration book of horses shall record:
(a) the date of birth of the foal,
(b) name of foal,
(c) sex;
(d) fires;
(e) the name and identification number of the mother and the name and register of the father,
(f) the number of the admission register;
