DECLARATION
of 6 November 2012
amending Decree No. 177 / 2009 Coll., on the Closer Conditions for Termination of Education in Secondary Schools by Graduate Examination, as amended
The Ministry of Education, Youth and Sports provides pursuant to Sections 81 (11), 91 (1) and 113a (2) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 242 / 2008 Coll., Act No. 49 / 2009 Coll., Act No. 472 / 2011 Coll. and Act No. 370 / 2012 Coll.:
Decree No. 177 / 2009 Coll., on the Closer Conditions for Termination of Education in Secondary Schools, as amended by Decree No. 90 / 2010 Coll., Decree No. 274 / 2010 Coll., Decree No. 54 / 2011 Coll. and Decree No. 273 / 2011 Coll., is amended as follows:
1. In Paragraph 1 (f), the word "documents' is replaced by" documents and files'.
2. In Article 1, point (j) is deleted.
Points (k) and (l) shall become points (j) and (k).
3. In Paragraph 2 (3), after the first sentence, the sentence "The written work may be carried out within an earlier period, but first on 1 April."
4. in Article 4 (1) (a), "15 November" is replaced by "1 December."
5. in Article 4 (2) (b) and (d), the words "and level of difficulty" shall be deleted;
6. in Paragraph 4 (5) (a), "30 November" is replaced by "15 December."
7. Paragraph 5 (1) and (2) reads as follows:
"(1) The didactic test from the test subject of Czech language and literature takes 60 minutes.
(2) Written work from the test subject Czech language and literature takes 90 minutes. Until that time the time for selecting the award referred to in paragraph 3 shall not be counted. ';
8. In Article 5 (3), the words "and for each level of difficulty 'are deleted.
9. Paragraph 5 (4) reads as follows:
"(4) At his request, the duration of the didactic examination from the Czech language and literature is extended by 15 minutes and the written work from the Czech language and literature by 30 minutes. In the course of the written work it is possible to use the translation dictionary and the dictionary of writing Czech."
10. in Article 6 (2) and (3):
"(2) For the oral examination of the common section, the school director shall, in accordance with the requirements catalogue, establish and make available to pupils by 30 September of the school year in which the graduation examination takes place a school list of at least 40 literary works. The school list shall be valid for the spring and autumn test periods following its disclosure to pupils.
(3) From the school list of literary works, pupils prepare their own list of 20 literary works according to the criteria for selecting the oral examination of the common part according to the catalogue. The application shall be submitted to the school director by 31 March for the spring examination period and by 30 June for the autumn examination period. If the student does not submit his own list of literary works by the specified date, he draws lots for all the works included in the school list of literary works for the examination of working papers. The school director shall provide working papers for pupils for works from their own lists of literary works. ';
11. in Article 6 (6), the words "at the same level of difficulty" shall be deleted;

(1) Testing from the test subject of a foreign language may be conducted from
(a) English,
(b) French;
(c) German,
(d) the Spanish language; or
(e) Russian language.
(2) The didactic test from the test subject of a foreign language takes 95 minutes, of which 35 minutes will listen to part of the test and 60 minutes will take part of the test verifying reading and language knowledge and skills.
(3) The written work on the test subject takes 60 minutes. "

Testing of mathematics
The math diagnostic takes 90 minutes. Before the beginning of the didactic test, pupils have 15 minutes to choose the solution procedure. "
14. Article 10 shall be deleted, including the title.
15. Paragraph 11 (1) reads:
"(1) The Centre shall deliver the relevant test documentation to the safety deposit box test site at the latest on the last working day of the week preceding the start of the didactic tests and written work referred to in Section 2. '.
16. In Paragraph 15 (6), the first sentence is replaced by the sentence "The preparation for the defence of graduation takes at least 5 minutes."
17. in Article 16 (1), the second sentence shall be replaced by the sentence "The published topics shall also be maintained for the repair and replacement tests."
18. In Paragraph 16 (2), the second sentence is replaced by "The preparation for oral examination shall take at least 15 minutes."
19. in Paragraph 22 (2), the word "the following" shall be replaced by "the following at the latest."
20. Paragraph 22 (3) reads:
"(3) Written works from a foreign language will be received by the evaluator from the Centre; the evaluation shall be transmitted by the evaluator to the Centre through his information system at the deadlines set by the Centre. The Centre shall make the results of the school director available during the spring examination period until the start of the oral examination of the common part in the relevant class and in the autumn examination period within 3 working days of the assembly of the evaluation of all written work from the foreign language of the pupils of the relevant class. Written works from the Czech language and literature will be received by the evaluator from the school director and the evaluation will be transmitted to the school director, who will send the Centre until the beginning of the oral examinations of the common part in the relevant class in the spring trial period and until 13 September in the autumn trial period. The school director shall notify the pupils of the results of the written work without undue delay. The dates of the opening of the oral examinations of each class shall be communicated by the Director of the Centre through his information system before the start of the written work. ';
21. in Paragraph 23 (4), the second sentence is deleted;
22. in Paragraph 23 (5):
"(5) The assessment of the mandatory tests of the common part on the basis of the results obtained in accordance with paragraph 3 shall bring the Centre to the classification scale the benefit of:
(a) 1 - excellent,
(b) 2 - praiseworthy,
(c) 3 - good,
(d) 4 - sufficient;
(e) 5 - insufficient. ';
23. In Article 23, paragraphs 6 and 7 are added:
"(6) The assessment of the optional tests of the common part under § 78 (5) of the Education Act on the basis of the results obtained under paragraph 3 shall transfer the Centre to the classification scale the benefits of:
(a) succeeded;
(b) failed.
(7) If the pupil did not pass the test or partial examination, the protocol shall state the word "did not (a)" instead of "benefit." '

Overall evaluation of the graduation exam and issue of the certificate
(1) The Centre shall make the results available to the Director of the School through the Centre's information system in the spring examination period no later than 2 working days after the collection of the results of the individual pupil during the spring examination period and in the autumn examination period no later than 2 working days after the collection of the results. The school director shall then issue, without undue delay, a certificate of graduation to a pupil who has successfully completed both parts of the final examination. The certificate shall be drawn up by means of the Centre's information system on the form in accordance with the Decree on certain educational documents13).
(2) The overall evaluation of the graduation examination is carried out according to the results of the compulsory tests of the common and profile sections according to the scale
(a) benefit from honours if the pupil has not been evaluated in any compulsory examination at a degree below 2 - commendable and simple arithmetic mean of the evaluation of all compulsory tests is not more than 1,50;
(b) benefit (a) if the pupil has not been assessed in a level 5 test,
(c) it has not benefited if the pupil has been assessed by a compulsory examination at a level 5 - insufficient or failed for other reasons.
(3) If the pupil did not perform a common part in accordance with § 81 (6) of the Education Act, the overall assessment shall be carried out only for the profile part.

25. in Paragraph 29 (2), "paragraph 3" is replaced by "paragraph 1";
26. in Paragraph 29 (4) (b) (1), the words "and difficulty levels" shall be deleted;
27. in Paragraph 29 (4) (b), the words "benefit" or "fail" shall be added at the end of the text of point 6. "
28. Paragraph 29 (6) reads:
"(6) A report on the results of the common part of the pupil's graduation examination shall be drawn up on a form the model of which is set out in Annex 4 to this Decree. ';
29. in Article 29a (3) (b) (1), the words "and the level of test difficulty" shall be deleted;
30. Article 33 shall be deleted, including the title.
31. in Paragraph 34, paragraphs 4 and 5 are deleted;
32. in Paragraph 38 (b):
"(b) proposes to the Centre pedagogical staff to train for the function of contracting authority and evaluator in the number needed to arrange the graduation exam at the school and, in the case of the contracting authority and evaluator, the written work from the Czech language and literature and the evaluator of oral examinations shall be determined by the place of establishment for the performance of his duties,"
33. Paragraph 41, including the title, reads:
Evaluator
Evaluator of the oral examination of the common part and written work from the Czech language and literature usually performs his duties at the school of which he is a pedagogical worker. If the school where the examinations are to be held does not have a sufficient number of teaching staff to fulfil the conditions for carrying out the evaluation function for the subject, the school director may appoint another evaluator in accordance with § 42 (3). Written works from a foreign language are evaluated by the evaluator through the Centre information system. '
34. In Article 44 (2), the words "and the evaluator of the written work from the Czech language and literature" shall be inserted after the word "part."
35. in Paragraph 48 (1), the words "referred to in Paragraph 10 (1) and the Czech language and literature of the test subject" shall be replaced by the words "established for the common part of the graduation examination."

Transitional provisions
1. The dates for holding the didactic tests and written work in the spring trial period of 2013 shall be determined by the Ministry by 1 December 2012.
2. The school list of literary works established by the school director pursuant to § 6 (2) of Decree No. 177 / 2009 Coll., as effective until the date of entry into force of this Decree, for the spring and autumn trial period of 2013 shall be considered as the school list of literary works established by the school director pursuant to § 6 (2) of Decree No. 177 / 2009 Coll., as effective from the date of entry into force of the decree.
Efficacy
This decree shall take effect on the day of its publication.
