DECLARATION
of 23 October 2020
on data contained in the cloud computing catalogue
According to Section 12 (1) (g) of Act No. 365 / 2000 Coll., on Information Systems of Public Administration and on the amendment of certain other laws, as amended by Act No. 12 / 2020 Coll.:
§ 1
Subject matter
This decree sets out the data to be kept in the cloud computing catalogue
(a) cloud computing demand;
(b) cloud computing offer,
(c) cloud computing used by public authorities.
§ 2
Definition of terms
For the purposes of this decree:
(a) cloud computing class in the form of infrastructure, cloud computing in the form of a platform and cloud computing in the form of application software;
(b) the cloud computing type of the cloud computing set, having the same purpose, the mode of performance of cloud computing and basic parameters,
(c) cloud computing areas, a group of cloud computing types within the cloud computing class which fulfil a similar cloud computing functionality;
(d) by the basic parameter of cloud computing, an indication describing the volume, power, price or other cloud computing properties;
(e) by the security certification of cloud computing, the confirmation that cloud computing has the characteristics required for inclusion in the relevant security level for the use of cloud computing by public authorities required by the legislation governing cyber security;
(f) security level security level in accordance with the legislation governing cyber security.
§ 3
Data on cloud computing demand
In the cloud computing catalogue, cloud computing requests are led
(a) data identifying cloud computing demand, which is:
1. name of cloud computing requested,
2. the validity of cloud computing demand;
3. the estimated use of the requested cloud computing time;
(b) data identifying the public authority requesting cloud computing,
1. name of the public authority;
2. the identifier of the public authority allocated to the public authority,
(c) data characterising the requested cloud computing, which is:
1. cloud computing class requested;
2. cloud computing area requested;
3. type of cloud computing demanded,
4. the basic parameters of the requested cloud computing,
5. security level of cloud computing requested;
6. security certification of the requested cloud computing.
§ 4
Data on cloud computing offer
In the cloud computing catalogue, cloud computing offers are kept
(a) data identifying the cloud computing offer as:
1. name of cloud computing offered,
2. the cloud computing demand identifier to which the cloud computing supply responds,
3. the validity of the cloud computing offer;
(b) data identifying the cloud computing provider offering cloud computing, which is:
1. in the case of a legal person, the trading firm or name, the identification number of the person or similar number assigned abroad and its registered office, if abroad;
2. in the case of an undertaking natural person, the trading firm or the name or, where applicable, the names and surnames, including the distinguishing supplement or the additional designation, the identification number of the person or similar number assigned abroad and its registered office, if abroad;
(c) data characterising the cloud computing offered,
1. the class of cloud computing offered,
2. the cloud computing area offered,
3. type of cloud computing offered,
4. the name of the specific cloud computing that corresponds to the cloud computing type offered;
5. the basic parameters of the cloud computing offered,
6. the security level of cloud computing offered,
7. security certification of cloud computing offered,
8. Indication of the intended place of processing of information by a public authority and the estimated time, the estimated extent and intended purpose of processing information by a public authority at that place.
§ 5
Data on cloud computing used by public authorities
In the cloud computing catalogue, cloud computing used by public authorities
(a) data identifying the cloud computing used as:
1. name of cloud computing used,
2. the start date of cloud computing,
3. the date of expected termination of cloud computing,
(b) data identifying the public authority using cloud computing as:
1. name of the public authority;
2. the identifier of the public authority allocated to the public authority,
(c) the data identifying the cloud computing provider that provides the cloud computing used, which is:
1. in the case of a legal person, the trading firm or name, the identification number of the person or similar number assigned abroad and its registered office, if abroad;
2. in the case of an undertaking natural person, the trading firm or the name or, where applicable, the names and surnames, including the distinguishing supplement or the additional designation, the identification number of the person or similar number assigned abroad and its registered office, if abroad;
(d) data characterising the cloud computing used as:
1. cloud computing class;
2. cloud computing area;
3. the type of cloud computing used,
4. cloud computing security level;
5. the identification number of the contract for the provision of the used cloud computing concluded between the public authority and the cloud computing provider assigned by the registry administrator of the contract register, if the contract is recorded in the contract register,
6. identifier of the public administration information system for which cloud computing serves.
§ 6
Efficacy
This decree shall take effect on the day following its publication.
