GOVERNMENT REGULATION
of 23 January 2002
amending Government Regulation No 445 / 2000 Coll., on the establishment of milk production quotas for the years 2001 to 2005, as amended by the Constitutional Court found published under No 410 / 2001 Coll.
The Government mandates pursuant to Sections 2 (5) and 12 (3) to (5) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and amending certain other laws (Act on the State Agricultural Intervention Fund), as amended by the Constitutional Court found in No. 410 / 2001 Coll.:
Government Decree No. 445 / 2000 Coll., on the establishment of milk production quotas for the years 2001 to 2005, as amended by the Constitutional Court found published under No. 410 / 2001 Coll., is hereby amended as follows:
1. in Article 2 (k):
"(k) the reserve volume of milk intended to establish new individual milk production quotas or to increase the established individual milk production quotas;"
2. In Article 2 (l), the words "not exceeding the volume fixed 'are replaced by the words" equal to the volume fixed'.
3. In Article 4 (1), the words "pursuant to Article 13 'are deleted.
4. Paragraph 4 (5) is deleted.
5. In Article 5 (3), the words "for the relevant quota year (Article 14) 'are replaced by the words" intended for distribution in the relevant quota year (Article 14 (4))'.
6. Paragraph 5 is deleted.
7. Paragraph 6 (4) is deleted.
8. In Article 9 (1), the words "by 31 August of the calendar year 'are replaced by the words" by 28 February of the quota concerned'; the words "by 31 October of the calendar year 'are replaced by the words" within 60 days of the end of the quota concerned'; the sentence of the third sentence is inserted after the sentence of the second sentence: "In the application the producer shall indicate the amount of the individual milk production quota available at the date of the application '.
9. in Article 9 (2), including footnotes (2a) and (3):
"(2) Compensation aid shall be fixed:
(a) for a producer whose share of the area of the agricultural parcels it has produced located in less favourable areas defined under the special legislation (2a) is at least 50% of the total area of the agricultural parcels it has managed, or for a producer who is an organic entrepreneur, (3) between 0,15 and 0,30 CZK per litre of milk delivered during the relevant quota year to a sales organisation or processor, or sold directly to the consumer under an individual milk production quota; the Fund shall publish in the Trade Bulletin within 60 days of the end of the relevant quota year,
(b) for other producers between CZK 0.10 and CZK 0.25 for each litre of milk delivered during the relevant quota year to the sales organisation or processor, or sold directly to the consumer under an individual milk production quota; the Fund shall publish in the Trade Bulletin within 60 days of the end of the quota year concerned.
(2a) Paragraph 8 of Decree No 505 / 2000 Coll., establishing support programmes to promote non-production functions in agriculture, to support the activities involved in the maintenance of the landscape, aid programmes to promote less favourable areas and criteria for their assessment, as amended by Decree No 500 / 2001 Coll.
3) Act No. 242 / 2000 Coll., on organic farming and amending Act No. 368 / 1992 Coll., on administrative fees, as amended. '
10. in Article 9, paragraphs 3 and 4 are deleted;
11. in Paragraph 10 (2):
"(2) The minimum price shall apply to all quantities of raw milk meeting the quality characteristics set out in Annex 6 to this Regulation supplied by:
(a) processors by a marketing organisation or producer within its individual supply quota;
(b) the sales organisation by the producer under its individual supply quota. "
12. In the second sentence of Article 10 (4), the word "monthly 'is deleted and the words" where it was' are replaced by the words "in the calendar month in which it was'.
13. The following shall be added at the end of Paragraph 12 (5): "and the amount of the levy for exceeding its individual supply quota '.
14. In Paragraph 14 (1), the words "may not exceed the volume 'are replaced by the words" must be equal to the volume'.
15. in Article 14 (2) to (4):
"(2) On 1 February 2002, the reserve amount shall be 212 million litres of raw milk.
(3) The reserve is increased by the volume of milk by which the individual milk production quotas have been reduced in accordance with Article 6 and by the volume of milk corresponding to the new individual milk production quotas whose effects have expired in accordance with Article 5 (4).
(4) The Government, acting on a proposal from the Ministry of Agriculture (hereinafter referred to as the Ministry), shall, no later than 20 days before the beginning of each quota year, determine the proportion of the reserve which may be distributed to the applicants referred to in Article 4 (1) in the relevant quota year. The Ministry shall submit a proposal to the Government on the basis of a forecast balance of domestic production, import, export and consumption of milk and milk products in the immediately coming quota year. '.
16. In Annex 4, Part C, in the title, the words "Declaration of Honor 'are replaced by the words" Declaration' and the second sentence is deleted.
17. Annex 5 shall be deleted;
This Regulation shall enter into force on 1 February 2002, with the exception of Article I (11), which shall take effect on 1 April 2002.
