DECLARATION
of 18 February 2003
amending Decree No. 335 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for soft drinks and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits and other alcoholic beverages, fermented vinegar and yeast, as amended by Decree No. 45 / 2000 Coll.
According to Article 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll. and Act No. 146 / 2002 Coll., ("the Act ') for non-alcoholic beverages and concentrates for the preparation of non-alcoholic beverages, fruit wines, other wines and mead, beer, consumable alcohol, spirits, other alcoholic beverages, fermented vinegar and yeast:
Čl. I
Decree No. 335 / 1997 Coll., implementing § 18 (a), (d), (h), (i), (j) and (k) of Act No. 110 / 1997 Coll., on foodstuffs and tobacco products and amending and supplementing certain related laws, for non-alcoholic beverages and concentrates for the preparation of soft drinks, fruit wines, other wines and mead, beer, drinking alcohol, spirits, other alcoholic beverages, fermented vinegar and yeast, as amended by Decree No. 45 / 2000 Coll., is amended as follows:
1. Paragraph 8 (4) is deleted.
Paragraphs 5 and 6 shall be renumbered paragraphs 4 and 5.
2. Section 3, including the title and footnote 2d, shall read:

„ODDÍL 3

LIVE AND DRINKS AT THE POINT OF LIVE
§ 11
For the purposes of this decree:
(a) a foaming drink made by the fermentation of a youth prepared from malt, water, unprepared hops, prepared hops or hop products which, in addition to the fermentation process of alcohol produced (ethyl alcohol) and carbon dioxide, also contains a certain amount of unfermented extract; the malt may be replaced by an extract of up to one third of the total extract of the original youth, in particular sugar, cereal starch, barley, wheat or rice; for beers flavoured, the alcoholic strength may be increased by the addition of spirit drinks or other alcoholic beverages,
(b) malted grain grains of barley or wheat which have undergone enzymatic transformation of the endosperm and the creation of typical flavourings and colouring agents;
(c) beer of lower fermented beer produced using the yeast Saccharomyces cerevisiae subsp. uvarum (carlsbergensis),
(d) beer of supra-fermented beer produced using the yeast Saccharomyces cerevisiae subsp. cerevisiae and, where appropriate, spontaneous microflora of milk or vinegar bacteria;
(e) light beer beer made predominantly of light malt;
(f) dark and semi-dark beer beer made of dark malt, caramel malt, or colour malt mixed with light malt;
(g) beer made at the turning by mixing light and dark beers of the same group, with a beer cut,
(h) light beer made mainly of barley malt with an extract of the original youth up to 7% by weight and a usable energy content of not more than 130 kJ / 100 ml;
(i) by-catch beer, beer made predominantly of barley malt with an extract of the original youth of 8 to 10% by weight,
(j) lager beer made predominantly of barley malt with an extract of the original youth of 11 to 12% by weight,
(k) beer special beer made mainly of barley malt with an extract of the original youth of 13% or more by weight,
(l) a porter of dark beer made predominantly of barley malt with an extract of the original youth of 18% or more by weight,
(m) beer with an alcoholic strength by volume not exceeding 1,2% (1,0% by weight),
(n) non-alcoholic beer with an alcoholic strength by volume of not more than 0,5% (0,4% by weight),
(o) beer with a reduced sugar content of deep-fermented beer with a loading carbohydrate content of up to 0,75 g / 100 ml and proteins up to 0,4 g / 100 ml,
(p) wheat beer beer produced with an extract content of more than one third of the total extract delivered,
q) yeast beer beer produced by an additional addition of the proportion of fermented youth into the finished beer during the rolling process;
(r) beer flavoured with beer made with the addition of flavourings and food supplements in accordance with the specific legislation (2b) and spirit drinks or other alcoholic beverages referred to in Section 16. The alcoholic strength by volume of spirit drinks and other alcoholic beverages may not exceed that of the original beer,
(s) sweet malt extract obtained using brewery technology,
(t) beer-based drink fermented malt drink or mixed beer drink,
(u) fermented malt drink drink made of sweetbread by brewery technology, possibly flavoured,
(v) a mixed beer drink (Beercooler) a drink made by mixing beer with a soft drink or with a beverage concentrate for the preparation of soft drinks and sodium water.
§ 12
Breakdown of species and groups
(1) Species
(a) beer;
(b) beer-based drink.
(2) Beer is divided into the following groups:
(a) light beer;
(b) nodding beer;
(c) lager,
(d) special beer;
(e) porter,
(f) alcohol-reduced beer;
(g) beer with reduced sugars,
(h) wheat beer;
(i) yeast beer;
(j) soft beer,
(k) flavoured beer.
(3) Beer based drinks are broken down into the following groups:
(a) fermented malt drink;
(b) mixed beer drink.
§ 13
Labelling
(1) In addition to the information provided for in the law and in the special legislation1), for beer the following shall be added:
(a) the name of the species and group referred to in Article 12;
(b) alcoholic strength by volume,
(c) the method of fermentation, if it is beer produced by the upper fermentation or by fermentation in a bottle;
(d) the entry "not filtered" if no filtration has been carried out;
(e) an indication of whether the beer is light, dark, semi-sparkling or cut,
(f) indication of the use of natural mineral water, 1a) if used for production.
(2) To specify the designation of a group of beers, only the value of the extract of the original youth, expressed as a percentage by weight, or the corresponding wording in Annex 5, may be used.
(3) Light beer and reduced-sugar beer must be labelled in accordance with specific legislation. 2d)
(4) For the purposes of labelling, beer made from barley malt, unprepared hops, prepared hops or hop products, with the exception of isomerised hop products, and water, shall be considered as a single ingredient food.
(5) In addition to the information provided for in the law and in the special legislation1), for beer-based drinks, the following shall be added:
(a) the name of the group;
(b) alcoholic strength by volume.
(6) For mixed beer drinks, the designation corresponding to the group of beer referred to in Article 12 (2) shall be given.
(7) Allowed negative volume deviations from the declared volume are given in Annex 5, Table 2.
§ 14
Quality requirements
(1) The physical, chemical and sensory requirements for beer quality are set out in Sections 11 (h) and 11 (o) and Annexes 5 and 6.
(2) Dark and semi-sparkling beer cannot be produced by coloring light beers.
(3) The fermented malt drink must meet the physical and chemical requirements for beer set out in Annex 5. No indication of actual fermentation shall be provided.
(4) The blended beer drink shall comply with the physical and chemical requirements for flavoured beer, non-alcoholic beer, or for alcohol-reduced beers as set out in Annex 5. No indication of actual fermentation shall be provided.
§ 15
Entry into circulation
Beer and beer-based drinks must be protected from direct sunlight and frost damage.
2d) Decree No 293 / 1997 Coll., on the method of calculation and presentation of nutritional (nutritional) value of foodstuffs and labelling of indications of possible adverse health effects. '
3. in Article 16 (b), including footnote 2e, the following shall be added:
"(b) an aromatising process whereby one or more flavourings are used in the manufacture of spirit drinks or other alcoholic beverages; (2b) for spirit drinks as referred to in Article 16 (o), (p), (q), (r), (t), (u), (v), (w), (x), (y), (z), (bb), (j), (k), (ll), (mm) and (pp), only natural flavouring substances (2b) and flavouring preparations may be used, 2e)
(e) Decree No 52 / 2002 Coll., laying down requirements on the quantities and types of food flavourings, their conditions of use, their health requirements and the conditions of use of quinine and caffeine. ';
4. In Section 16, footnote 2e is added at the end of point (d).
5. in Paragraph 16 (i):
"(i) alcoholic beverages containing at least 15% by volume ethanol, with the exception of wine, beer and beer-based drinks; for egg liqueur, a minimum ethanol content of 14% by volume is permitted, ';
6. In Article 16 (m), "qq) 'is replaced by" pp)';
7. In Article 16, at the end of the text in point (y), the comma is replaced by a semicolon and the words "the distillate of plums or slivovitz shall also be considered as a distillate produced by addition, before the second distillation, not more than 30% by volume of lihu3a) to the plum distillate, provided that the characteristic flavour, aroma and colour, typical of plum distillate, is maintained. ';
8. in Paragraph 16 (kk), in the sentence behind the semicolon, the words "ethanol distillate" are replaced by the words "alcohol of distillate or macarate."
9. in Paragraph 16 (nn):
"(nn) a spirit drink produced from alcohol, water and rum punishments, the basis of which is acetate and ethyl formate, dyed in a spirit ball, the addition of vanillin, vanilla and sugar being possible, '.
10. in § 16, point (qq) reads:
"(qq) other alcoholic beverages with a reduced alcoholic strength by volume of a beverage containing more than 0,5% by volume of ethanol and not more than 1,2% by volume of ethanol.";
11. in Paragraph 18 (1) (c), the word "ready" shall be inserted after the word "in 1 litre."
12. In Article 18 (1), at the end of the text in point (d), comma is replaced by a semicolon and the words "the sugar or honey content must be at least 150 g / l of finished product, 'are added.
13. in Paragraph 18 (3), point (o) is deleted;
14. In Paragraph 18, at the end of paragraph 7, the sentence "This does not apply to liqueurs under paragraph 12. 'is added.
15. in Paragraph 18, paragraph 9 is deleted;
Paragraphs 10 to 12 shall become paragraphs 9 to 11.
16. in Paragraph 18 (10):
"(10) The absolute value of both positive and negative deviations of the ethanol content by volume, from the ethanol content indicated on the packaging, shall be allowed not more than 0,3% by volume; in the case of alcoholic beverages containing macerated fruit or parts of plants, the value shall be 1,5% vol. ';
17. in Paragraph 18 (11):
"(11) For spirit drinks, the composition does not need to include water."
18. In Paragraph 18, paragraphs 12 to 14 are added:
"(12) For distillate-based liqueurs, the name of the distillate may be used in the compound name provided that the ethanol of the product originates from less than 100% and more than 50% of the said distillate.
(13) Spirituous beverages shall not be labelled with words or phrases such as "type," "like," "style," "brand," "flavored," or other terms of similar importance if they are associated with the name of the species, group or subgroup of the spirit drink.
(14) Where an addition of alcohol has been used in the manufacture of plum distillate in accordance with Section 16 (y), this shall be indicated in the product designation. ';
19. in Paragraph 19 (2), the words "and must be free from foreign flavours and flavours" shall be added at the end of point (a).
20. Article 20 shall be deleted;
21. in Article 24, the following paragraph 3 is added:
"(3) The permitted negative deviation of the acetic acid content by volume, from the acetic acid content on the packaging, shall not exceed 0,2%. '
22. In Annex 5, the current table becomes Table 1 and Table 2 is added as follows:

23. in Annex 5, Table 1, Notes (1) to (3):
"(1) In the case of data, with the exception of those referred to in Notes 2 to 4, marked on the packaging in quantitative units, the absolute value of both positive and negative deviations of 10% relative shall be allowed unless it is indicated that they are average values.
(2) In the case of beers with an alcoholic strength of more than 1,2% and up to and including 5,5% vol, the absolute value of the positive and negative differences of 0,5% vol. from the declared value shall be accepted and in the case of beers with an alcoholic strength of more than 5,5% vol. the absolute value of both positive and negative deviations of 1,0% vol. from the declared value shall be accepted, while respecting the minimum or maximum set values.
3) In addition to beer stored under the atmosphere of other packaging gases or propellants according to Annex 1, Part 15, paragraph 2, of Decree No. 53 / 2002 Coll., as amended by Decree No. 233 / 2002 Coll. '.
24. in Annex 5, Table 1, note 4, the second sentence is replaced by the following: "On the packaging and accompanying documents, the content of the original youth shall be assessed by a value rounded down to the whole number."

Čl. II
Transitional provisions
1. Foodstuffs produced and put into circulation before the date of application of this Decree shall be assessed in accordance with existing legislation.
2. Food labelling under existing legislation may be used by 30 April 2004 at the latest, except for the distillates referred to in Article II (3) and domestic rum referred to in Article II (4).
3. Distillates cut and distillates cut fine marked according to § 18 (1) (d) and (e) of Decree No. 335 / 1997 Coll. and manufactured or imported by 31 December 2002 may be put into circulation by 31 December 2003 at the latest.
4. Domestic rum corresponding to the definition of § 16 (nn) of Decree No. 335 / 1997 Coll. and produced until 31 December 2002 may be put into circulation by 31 December 2003 at the latest.
Čl. III
Efficacy
This Decree shall take effect on 1 January 2004, with the exception of Article I (3), (7) and (9), which shall take effect on 1 March 2003.
