THE LAW
of 13 June 2012
amending Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the Fisheries Guard, the conservation of marine fisheries resources and the amendment of certain laws (Fish Act), as amended, and Act No. 200 / 1990 Coll., on infringements, as amended
Parliament has decided on this law of the Czech Republic:
Amendment of the Fisheries Act
Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the Fisheries Guard, the Conservation of Marine Fishery Resources and the amendment of certain laws (Fisheries Act), as amended by Act No. 444 / 2005 Coll., Act No. 267 / 2006 Coll., Act No. 124 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 104 / 2011 Coll., Act No. 375 / 2011 Coll. and Act No. 18 / 2012 Coll., is amended as follows:
1. In Article 20, the following paragraph 3 is added:
"(3) The Municipal Office of the Municipality, with extended jurisdiction, deals with offences (§ 30) and administrative offences (§ 31)."
2. in Article 21 (2), point (g) is deleted;
Point (h) shall be renumbered as point (g).
3. in Paragraph 30 (1), the dot at the end of point (h) is replaced by a comma and the following point (i) is added:
"(i) catches fish without right."
4. In Paragraph 30 (6), after the second sentence, the sentence "For an offence referred to in paragraph 1 (i), a fine of up to 8 000 CZK shall be imposed; a prohibition of activity of up to one year may also be imposed for this offence. ';
5. In Article 31 (8), the words "the region of delegated responsibility is the income of the relevant region 'are replaced by the words" the municipal authority of the municipality with extended scope is the income of the relevant municipality with extended scope'.
TRANSITIONAL PROVISIONS
1. Proceedings on infringements or other administrative delicacies in the fisheries sector under Act No. 99 / 2004 Coll. or Act No. 200 / 1990 Coll., as effective until the date of entry into force of this Act, which was not definitively terminated before the date of entry into force of this Act, shall be completed in accordance with the existing legislation.
2. Proceeds from fines imposed by the Fisheries Guard or Region of Transferred Jurisdiction pursuant to Act No. 99 / 2004 Coll., as effective until the date of entry into force of this Act, are the income of the respective county.
EFFECTIVE
That law shall take effect on the first day of the second calendar month following its publication.
